Transcription

and comeing from the River of Bourdeaux designed for Ponterdeaux in
ffrance, one Monsieur Pananel or Panane, (as this deponent remembreth his name)
being the freighter who laded the said ship at or neere Bourdeaux aforesaid
caused and procured a french Pylott to come aboard the shipp Saint Peter
aforesaid expressely to Conduct her thence to Pontereaux, and to take a Care of
her pyloting to Pontereaux aforesaid, And saith the said french Pylott was
not at all hyrred by this deponent then Master of the said shipp, and that hee was and
remained on board the said shipp at such time as shee lay at an anchor and
fastned to the rocks as aforesaid, The premisses are well knowne to this deponent
being Master of and aboard the said shipp during the whole Voiage in Controversie
And further cannot depose./

To the third article hee saith and deposeth , That the said ffrench Pylott perceiving
the approach of the said man of warr, endeavouring the preservation of the said
shipps ladeing, called a ffrenchman ashoare, who came with two shallops aboard
the said shipp aand towed the same to the Land, and afterwards there came aboard to the number of 20. or 30. men or thereabouts with musketts ginns
and small shott which they brought with them from land, and made resistance
and shott against the said man of warr, all which was done contrarie to the expresse order
and direction of this deponent then Master of the said shipp, and contrarie to the likeing
and without approbation or assistance of or from this deponent or his said shipps Companie
or of any of them, The premisses hee well knoweth and deposeth for and upon
the reasons herein expressed. And further, saving his subsequent depositions hee saith
hee cannot depose./

To the 4th hee saith, That the said shipps Companie consisted of this deponent the
Master, and of five men more and one boy, And that when the frenchmen
aforesaid came aboard the said shipp in manner predeposed, the said shipp then
being within the reach of small shott from the shoare of france
(from whence more force of men might easily have been sent and by force habve
come aboard his said ship) this deponent and Companie were not at all in a
Capacitie to make resistance against the violent intrusion of the said ffrenchmen
at such their entring, Which hee well knoweth for the reasons before expressed, And
further, saving his orecedent and subsequent depositions, cannot depose./

To the 5th and 6th articles hee saith, That after the said ffrenchmen or
about the number aforesaid had by violence entred the said shipp contrary to
the likeing and approvbation of this deponent and Companie, this deponent above
20. times, before any opposition made against the said man of warr, perswaded
commanded abd earnestly entreated the frenchmen aforesaid not to shoot at
or agiants the said man of warr, but they not regarding such his commaunds or
entreaties and so much over-powring his Companie did make resistance against the
said friggot or man of warr, this deponent and Companie not being able to hinder
or prevent the same, And hee further saith that this deponent and Companie
did not at all contribute to the opposition and resistance made as aforeaid, but
that the same was totally made by frenchmen who had intruded into the said shipp
and by others from shoare, and saith that in the said opposition onely three shotts
were made with the Ordnance aboard the said shipp Saint Peter, two whereof
were with bulletts, and one with powder onely, all made by the said frenchmen
directly contrary to the good will and likeing of this deponent and Companie and
contrarie to this deponents expresse Commaund as aforesaid, And further
