Transcription

To the 6 and 7th articles of the said Libell hee saith and
deposeth that after the decease of the said Hobby in the Bu[?nn]eeme
River and after such tyme as the said ship the Mary Constant
came backe againe into Cormantine Road in Guinney to the
ship the Arrana Merchant the arlate Henry Evans in this deponents
presence and heareing came abord the said ship and did then and
there demand and seize upon all and singular the said goods
and Merchandizes schedulated and tooles and clothes of which the said Hobby dyed
[XXXXed] and the same did take away with him and carry away from thence
and converted them to his owne use without giveing any accompt
thereof either to the producent or any body else that this deponent knoweth
or hath heard of. How beit hee saith that before such tyme as the said
Evans tooke away the said goods from abord the Mary Constant David
Tuckerman the Master of the said ship would not let them goe before hee
gave him a receipt for them under his hand whereupon the said Tuckerman
tooke pen and Inke and wrote a receipt for the same, to which the
said Evans in this deponents presence did sett his hand and soe had the
said goods Tooles and clothes carry from abord that ship with him. And
further hee cannott depose saveing that at such tyme as the said Evans
soe seized upon the said goods schedulated they were of this deponents
knowledge well worth all and singular the sommes of money in the
said schedul[?a] conteyned and Expressed. and for soe much the same
might at that tyme have there bin sould to others;

To the 8th article hee cannot depose.

To the 9th hee saith that the said Henry Evans was and is an English[?e GUTTER]
man and a subiect of this Comonwealth and one who thereby is as had [XXXXX GUTTER
subiect to the Jurisdiction of this Court And further hee cannot depose

To the 10th hee saith that what hee hath predeposed is true.

To the Interrogatories. [CENTRE HEADING]

To the first Interrogatorie hee saith that hee cometh requested by the producent
to testifie in this cause and saith hee expecteth no[?e] thing save such an allowance [?for GUTTER]
his charges and expences for soe [?doeing]. and that hee oweth noe man
a farthing, but hath hee thanketh god enough with his blessing to
mayntayne him by his owne fa[XXX] Endeav[?ares] And otherwise
hee cannot depose.

To the second Interrogatorie hee saith that hee was not of the company of the
ship the Arrana Merchant interrogated in the voyage interrogated but did belong
unto the ship the Mary Constant when the said Lawrence Hobby[?e GUTTER]
dyed abord her as hee hath predeposed to which hee referreth himself[?e GUTTER]
And saith that hee knewe the Interrogated Andrew king but [?whether GUTTER]
hee bee an honest man or noe hee knoweth not, but saith hee
hath heard some men give himnoe very good report.

To the last Interrogatorie hee answereth negatively saying that hee [XXX GUTTER]
knew or heard any thing to the effect interrogated And
otherwise referring himselfe to his foregoeing deposition hee saith hee
cannot depose.
