of three severall fourth parts
of the shipp The Charity of}
Lynne (whereof Evert Everson}
is master) against the said three}
severall fourth parts of the}
said shipp as severally belonging}
unto them the said William Murford}
James Lynam and Mathias}
Molins and against the said}
Evert Evertson in speciall}
and others in generall ffrancklin}

Which day ffrancklin
exhibited his proxie
for the said William
Murford James
Lynam and Mathias
Molins and made
himself party for
them Then appeared
personally the said
Evert Everson master of
the said shipp the Charity
in whose presence the said
ffrancklin to all effect in Lawe
alleadged That the said William
Murford was and is lawfull owner and
Proprietor of one fourth part of the said
Shipp and her Tackle and furniture, and for
such commonly accompted, and that he ws and is in the
true reall and actuall possession thereof, and that
the said James Lynam was and is the lawfull owner
and Proprietor of one other fourth part of the said
shipp and her Tackle and furniture, and for such
commonly accompted and in the true reall and actuall
possession thereof, and that the said Mathias Molins
was and is the true and lawfull owner of one other
fourth part of the said shipp the Charitye and of her
Tackle and furniture, and for such commonly accompted
and in the true actuall and reall possession thereof
And that the said Evert Everson was appointed master of
the said shippe by the said Murford Lynam and Molins
and putt master into the said shipp for them and to their
use which allegation the said ffrancklin proposed ioyntly
and severally and prayed the same to be admittedm and
the Judges at his petition admitted the same, which being
admitted and repeated and the said Everson not beleeving
the same, the said ffrancklin produced upon the same
the said Evert Everson a party principall to whome the Judges
administred an oath to make his answer thereunto
upon his oath wh[?oe] upon his oath did iudicially confesse that the said William
Murford James Lynam and Mathias Molins were and
are the severall and respective lawfull owners of the
severall and respective 4 parts of the said shippe and
her tackle and furniture videlicet in all of three 4th parts
of the said shipp and her tackle and furniture and that
they were and are severally in the true reall and actuall
possession of the same three severall 4th parts
of the said shipp and of her tackle and furniture
and that he the said Evert Everson was appointed master
of the said shippe by the said Murford Lynam and Molins
and that he is in possession of three 4th parts of the
said shippe to be master onely to and for the use of the
said Murford Lynam and Molins which confession the
said ffrancklin accepted and the Judges at ffrancklins
petition deceased the said Murford Lynam and Molins
to be defended and continued in the possession of the
said three severall fourth parts of the said
shipp and her Tackle and furniture./
