Transcription

Leith and bound for Rotterdam and hee this deponent then a skee the said nKircoff
whether hee was bound and hee replyed to Rotterdam noherepon this deponent
told him hee was glad of this Company ˹and˺ thee sayd Kircoff thereupon
dranke to this deponent and told him it was well and bid him and loaned or
to that effect and this deponent according as the use is at sea when shipps keepe
Company and associate togehter dranke againe to the sayd Kircoffe And hee
saith hee this the union all that night stXXXed day after they were well TO DO: together?GUTTER
and all the night thereof steeved the same cause an by the light of the sayd
man of warr and his other shipps that were in his company And hee saith
that the next day in the morning videlicet on the 11 th of March aforesayd thee
They mett with three fflandrians men of warr belonging to dunkirke and Ostend
who persuad the union and some other vessells in Company with the sayd
Kircoff, XXXX the sayd kircoff perXXXbing which the sayd Kircoffe not
away endeavoured to present, either by spareing of sayle, or makeing up
to their releefe, or in any waives XX countenansed them in the least but
made away from them and two other shipps in his company without
makeing any resistance ˹in their behalfe˺ against the sayd 3 fflandrians men of warr by
by meanes whereof the union and her ladeing consisting of sugars tabaccoe
Coales and other goods to rich goods to a very considerable value at the least
three thousands pounds sterling, and alsoe three other other shipp (whereof
one was a dutch shipp ˹one Reynolds in˺ and by that meanes afterwards discharged) were
alsoe surprized and the ˹shipp and˺ ladeing of the other two which appears not to be dutch
was xx seized and by the sayd 3 men of warr carried to Dunkirke and Oastend
videlicet the union ˹and her ladeing˺ to dunkirke and the other too shipps and their ladeing which belonged
to English and Scotch men to Ostend And further to this Interrogatorie hee cannot
answere saving his subsequent deposition/

To the last hee saith at the tyme Interrogatorie these were pipe vessells
or thereabouts together in company with the sayd kircoff when the sayd
3 men of warr persuad the union and the other shipps in manner afore
sayd, And hee this deponent is verily persuaded in his conscience (for
that hee this deponent had 14 gunnes monted in his shipp the Union
and the other shipps taken which did maynteyne fight a while with the
sayd men of warr, and the other shipps take had alsoe some gunnes
in them,) that if the sayd XXXX Kirkoffe with his Holland man of warr
had ayded and assissted the sayd shipp Union neither she in the least,
neither shee nor her ladeing nor the other shipp had bin taken And
saith as aforesayd the ladeing of the shipp Union and her ladeing were
worth at least three thousand pounds sterling And saith all the Interrogatorie
Goslyn weley Neromay Knowles Pearson and others of leith and saint.Johnstons
XXX interrogate ˹subiects of this Commonwealth˺ were the lawfull Owners of the sayd shipp Union and XXX
ladeing X the gre of and of the greatest part of her ladeing, And saith
hee hath heard by letters and otherwise from such as have soone her at
Zealand middlebrough in Zealand that shee was the Union after
her being soo taken was sold to some of middleburrough and is nor
in the possession of one Sieder Lawrison who is now skipper of her

And further to his interrogatorie hee cannot answere/
