which nights that this deponent was aboard the said
man of warr he the deponent could and did well and
easily heare some of the Company of the said man of
warr to goe in the long boate severall times aboard the
arlate shipp the Crosse of Jerusalem, and returne againe
with such goods as they pleased to plunder out of her, And
further he saith he cannot depose.

To the fifth he cannot depose.

To the Interrogatoryes./ [CENTRE HEADING]

To the first Interrogatory he answereth that he was and is Master
of the shipp interrate, And that he commeth to bee a wittnes at
this time by the meanes of the Agents of the Claymers
And to the rest he answereth negatively.

To the second Interrogatory he answereth that he saw the said
sixe bales of Linnen putt or laden aboard the interrate
shipp otherwise he would not have signed the bill of lading
for them, and that they were laden at Saint Mallo's, and
that the said Linnens as all the other goods laden aboard the
said shipp were received either by him theis Rendent or his
steersman, and that they were laden in the hould after the Main Mast
of the said shipp, Annd further he knoweth not.

To the third Interrogatory he answereth that he entred the said
6 bales of linnen into his booke at Saint Mallo's at the time of the ladung
them aboard the interrate shipp the Crosse of Jerusalem, And
otherwise referring himselfe to the said booke he knoweth not
to answere.

To the fourth Interrogatory he answereth that the dry fatts of
hatts interrate were all laden aboard the shipp interrate at
Saint Mallo's in the sight of him the Rendent, and that they
were laden in the hould by the Main Mast of the said shipp
and that the said ffatts were received aboard the said shipp
by the Steirsman And further he cannot answere.

To the fifth and sixth interrogatories he answereth that the Captaine
and Company of the man of warre tooke the keys from him
this Rendent of the hatches, and thereby [?came] unto the
said goods and plunderd what they pleased, And further
to the sayd Interrogatories he cannot answere
saving the shipp the Crosse of Jerusalem was in the Channell
betweene [?Roscow] and Plimouth when the said Captaine and
company tooke away the said goods.

Peter Baly of Amsterdam Mariner, aged 32 yeares or thereabouts
sworne and examined.

To the first article of the said allegation hee saith and deposeth that all such
bales of linnen as were in and onboard the said shipp the Crosse of Jerusalem

laden and stowed in the hold of the said shipp and were in her hold at the
