Friday the twentith day of
June 1656. before the
worshipfull John Godolphin Doctor
of lawe and Charles George
Cocke Esquire Judges etcetera in the Common
hall etcetera in the presence of Samuel
howe Notary publicke Appeared the
said Smith and prayed that the Court would
proceed to the taxation of the charges touching
the arrest of the shippe the Julian mentioned in
the proceedings of this cause and likewise prayed the
said Miler to bee released from the arrest made
upon him by authoritie of this Court and discharged
out of prison Whereupon the Judges assigned to heare
their order upon the petition of the said Smith too
morrowe morninge and ordered that notice bee
given to Mr Budd to bee present the same time/.

Which day the said ffrancklin desired
this cause to bee assigned to sentence in
the presence of Suckley dissentinge and
alleadginge that one Cutbert Eager is a
necessary witnes for the proofe of the matter by
him in this cause alleadged whoe is nowe in the
Downes in the immediate service of this Comon=Wealth
for whose examination hee desired a competent
time to bee allowed him the said ffrancklin
dissentinge etcetera Whereupon the Judges assigned the
said Suckley to prove the matter by him in this
cause alleadged and to have the same proved within
a moneth and decreed a Commission for the
examination of the said Cutbert Eager returnable
within a moneth./.
