not compelled to appear by any proces or order of this Court, and saith hee is a fisherman of the
hundred of ffeversham and useth to fish in the places in question and saith hee would if it were in
his power give the victory in this cause to them that have most right thereto soe farr as his judgment
would leade him, and saith if the cause goe against the ffeversham men hee shall be much
preiudiced thereby his living consisting for the most part in fishing on the grounds in question, and
that it will be great benefit to him if the ffeversham men prevaile therein.
To the 2 hee saith the place in question lyeth within the ebbing and flowing of the sea but is not
accompted an arme thereof it being but a smale river about a myle or somewhat lesse broad from
shoare to shoare at high water and about a quarter of a myle broad at low water, and saith noe
shipp of any great burthen such as is interrogate can ride(?) therein because the mouth of the River
is shallow and will not admitt a shipp of any great burthen And to the rest of the Interrogatorie he
saith hee hath satisfied the contents thereof before.
To the 3 hee saith hee was about 10 or 12 yeares since at a Vice Admiralty Court held at Rochester (
by Sir Thomas Walsingham and stewards) but was not of the jurie there nor knoweth who were jury
men there? and to the rest of the Interrogatorie hee answereth negatively for that hee well
knoweth that the grounds in question are appointed by authority of the Court of the Mannor of
ffeversham upon to be laye in and when broken open, and the offenders against such orders were
punished, and for that hee knoweth the jury of that court are none but tennants of the mannor and
hundred of ffeversham
To 4th hee saith saving his foregoing deposition to the allegation made in this cause in the article of
Court to which hee referreth hee cannot answere having never heard of any such complaint as is
Interrogate
To the 5th hee saith hee can write his name but not reade written hand very perfectly and to the rest
of the Interrogatorie hee answereth negatively
To the 6th hee saith hee hath answered the contents thereof in his answere to the first Interrogatorie./
To the 7th hee saith hee knoweth the oysters ( predeposed to be bought by this deponent for storing
the grounds in question) were not taken out of the sea for that hee sawe them taken out of other
grounds where bedds of oysters were kept. And further hee cannot answere./
To the 8th hee saith there are other fish as soles dabbs thornebacks damsells and other small fish
taken upon the grounds in question by this deponent and other the tennants of the mannor and
hundred of ffeversham, but by noe other as hee beleeveth unlesse secretly as by stealth and further
saving his foregoing deposition hee cannot answere
To the last hee saith hee never knew nor heard of nor beleeveth anything ?contryved in this
interrogatorie./
