MEMORANDUM FOR SETTLING MY ESTATE 1670
MY LANDS TENEMENTS AND HEREDITAMENTS whatsoever and wheresoever Excepting ??Mar xr To be setled in case I have noe heires males or more daughters upon my daughters Eliz: and mary Lewys in equall shares and the heires of their Two bodyes lawfully begotten And for want of such To the Right herires of my selfe My mannor or Lordshipp of Marr Together with all my Lands thereunto belonging in the tenure and occupaccon of my Brother Capt Edward Lewys To whom they are now by lease demised (under a Certaine REnt) for and during his life, I give absolutely and ffreely unto him my said brother and to the heires Males of his body lawfully begotten for ever atquitted (sic) ?and bequeath from the aforemencconed Rent reserved Together with the Arrears ariseing thereby As alsoe my lands in Bawin Bentley and elsewhere purchased from S:r John Rang and M:r Sheppard To Commence from the day of my death And for want of heires Males of his body lawfully begotten Then to descend To my said daughters Eliz: and Mary And the heires of their Two bodyes lawfully begotten or to be begotten paying One Thousand pounds unto his Daughter or daughters if any surviving when sixteen yeares of age and for want of such unto my next heires for ever
I give and bequeath unto each of my owne sisters (viz:t= M:r Mary Wortley M:rs Anne Rumball M:rs Isabella Johnson The Lady Jane Holliers and M:rs Elizabeth Haynes To each ffifty pounds per Annum Rent Charge yearly issueing out of all my lands to be halfe yearly paid them from the next Rent day either Whitsontide or Mar:t: That shall happen within Six moneths after the day of my death during their naturall lives But to be Conveyed into ABC (in trust for their uses, Soe that it shall not be in the power of their husbands to meddle with it nor themselves to sell it upon any accompt whatsoever but to be reserved for their certaine maintenance And into M:rs Sarah Chadswick I alsoe give fforty shillings per Annum during her life To be paid as aforesaid I give and bequeath unto my wife All her owne wearing Jewells for ever And soe long as she shall live a widdow (In case she survive mee) The use of all my Plate and household stuffe in my house att Ledston Butt att the day of her marriage or death To belong unto my Executo:rs in Trust for my said Daughters I give unto the lady Butker ny Aunt in Iereland And to her sonne ffrancis and each of her Two daughters Mary and Jani if Liveing att my decease Twenty pounds a peece to buy mourning wich As I alsoe doe unto M:r Richard kay of Barnbrough and to my Cosen his wife Twenty pounds betwixt them to buy mourning with And XX to each of my owne sisters with their husbands (That shall then have any) I bequeath Twenty ffive pounds for the same purpose I give unto my ffather in law S:r Thomas ffoote Thirty pounds to buy him mourining with And to my Brother in law S:r ffran: Rolle and Lady ffifty pounds to buy them mouning with And unto my brother in Law M:r Arthur Onslow and his wife ffifty pounds alsoe To buy them mourning with (if they be liveing att my decease or twenty ffour pounds
