To the fifth, sixth, seaventh and eighth hee referreth himselfe to
his said foregoing deposition, and otherwise hee cannot depose.
To the 9th hee referreth him selfe to the lase and the Registrie of this
Court.
To the last hee saith his foregoeing deposition is true.

Examined upon an allegation on that
behalfe of his highnesse
the Lord Protector given in the
16th instant.

Captaine Gabriel Saunders commander of the
Tyger frigot in the service of this Commonwealth
aged 43 yeares or thereabouts sworne and examined.
To the first article of the said allegation hee saith and deposeth that the
said shipp the Orange tree at such time as shee was taken and seized
by this deponent and companie in the shipp the Tyger frigot in the
imediate service of this Commonwealth was bound (as her master
confessed to this deponent) with her lading for Roane in ffrance
where (according to the said confession) the said lading was to be
delivered and dischardged, And otherwise hee cannot depose.
To the second article hee cannot depose.
To the third article hee saith and deposeth that upon the said seizure
the said master of the Orange tree confessed to this deponent that
the said shipp came first from Amsterdam to Roane, and that after her arrivall at Roane, shee was taken to
freight by a ffrench man or ffrench factor to goe from Roane for
Nantes and thence to Porto Port in Portugall and thence to retourne
to Roane and there to deliver such lading as shee should bring from
Portugall, and that accordingly shee went from Roane to Nantes
and thence to Porto Port, and was thence retourning from Roane
when this deponent seized her, which seizure was made neere by
Seine head, on the 16th of May last, both which parts of Roane
and Nants hee saith are in the dominion of the ffrench kinge.
And hee further confessed that there were noe goods carried in the
