sayd shipp against the Shipp the Exeter Merchant}
whereof Thomas Woodfin was Master and against}
the sayd Thomas Woodfin and Company comming}
in for their Interest et cetera Smith Suckley}
Examined upon a libell on the behalfe
of the sayd Bland and Company and
on the behalfe of the sayd Bathurst
Baker and Clarke./

Thomas Ellis of the parish
of Saint Katherine neere the Tower
of London Cooper aged 44 yeares or there=
abouts a witnesse sworne and examined saith
and deposeth as followeth videlicet
To the first article of the sayd libell hee saith That during all the
months arlate of March Aprill May and June 1655 the arlate John
Bland and Company were and at present are commonly accompted and
reputed the true and lawfull Owners and Proprietors of the arlate
shipp the Pilgrim and of all her tackle apparrell and furniture
this hee knoweth being then Cooper and Steward of the sayd shipp
and having bin soe during her whole last voyage And by that
meanes hee alsoe knoweth that the arlate Samuell Bathurst in the tyme aforesayd was
reputed lawfull Owner and Proprietor of one hundred and fiftie butts of
oyle then on board the sayd shipp and the arlate Richard Baker the
aforesayd reputed Owner of Twenty butts of wyne then alsoe aboard the sayd
shipp, and the arlate George Clarke the tyme aforesayd reputed Owner
and Proprietor of fiftie butts of oyle then alsoe aboard the sayd shipp
and hee beleeveth them soe to bee for that hee this deponent being steward
and Cooper the sayd voyage sawe the sayd wines and oyles laden aboard
the sayd shipp for the respective Accompts of the sayd
Bathurst, Baker and Clarke And further to this article hee
cannot depose./
