taken the said shipp and lading they cared not who answered or
made satisfaction for the same or words to that or the like effect,
and the said Lieutenant and Companie at the first meeting at sea also told the said Gainer and others of the
hopewells Companie that the said man of warr belonged
to holland, and as the said Gainer and Contests have since understood
was called the dove. The said gainer and Contests aforementioned
doe futher joyntly declare, That the said shipp hopewell was very
much damnified by the said fight in her hull tackle and
furniture, her masts all broken and shattered, and her sailes all
shott in peeces to the valew of 500. or 600. li sterling as they verily
beleeve, and that the lading of Corne which was then aboard her
was damnified wett and spoyled by meanes of the water received
into the said shipp by the great shott of the said dutchman of warr
discharged into her betwixt wind and water, insomuch That the
said William Watts the Commander upon his arrivall at Mallega
finding his said shipp and her lading in that sadd condition and
not able to proceed further, was constrained with much
difficulty and expence to unlade the said Corne though in that
wett and perished condition, so that theise deponents verily beleeve
the said lading of Corne was and is utterly lost to the
Owners thereof, the same being as they can best estimate it
about 280. tunns of barley and wheate The premisses theise
deponents declare for a certaine trueth, as being all of them in
their severall qualities aforementioned belonging to the said shipp
hopewell in the Voiage aforesaid And thereby
taking speciall notice and observation of the encounter and
transactions predeposed And further cannot depose./
