counselled Captaine [?SaXXXan] commander of the Sara
to stay for the comming from Ctorus of Captaine Badiley (who
was not then come back) who answered this deponent that
hee having the company of Captaine [?Spanrer] in the
Sara was not afraid of the dutch, nor feared any warr with them,
howbeit hee resolved to depart for England in the company of the
Sara without expecting the retourne of Captaine Badiley,
and did depart accordingly about two or three dayes before
Captaine Badileys retourne, who was daily and almost hourely
expected before such their departure, all which hee knoweth
being then at Zant and seeing and knoweing the premisses to be
soe donne. And sairg gee gad afterwards advice from England
of the safe arivall there of the said shipps. And otherwise
hee cannot depose, saving that when Captaine Badiley (after about
a fortnights stay at Zant after such his retourne) departed thence there
was only a rumor and noe certaintie of any breach with the dutch.
Upon the rest hee is not examined by direction of the producent.
To the Interrogatories. [CENTRE HEADING]
To the second hee saith hee hath not seene any goods weighed
either ar Ligorne or Porto fferara, nor was ever at either of those
places, And otherwise hee cannot answer saving as aforesaid.
To the third hee saith that hee was never at Cyprus or Scanderone,
but knewe one Roger ffowke at Constantinople who was brother to
the interrogated ffrancis ffowke, And otherwise hee cannot answer.
To the fifth hee saith that in his iudgement a master of a shipp
not knowing of any apparent danger, ought not to waite upon a
convoy but to followe his imployment, And otherwise hee cannot
answer.
To the 7th hee saith it is an usuall thinge for factors not
having goods enough fully to lade a shipp for the freighters
accompt, to lade goods for other men or permit others to lade
to supplie the rest of her lading, and saith the master
is bound to take the same in, And otherwise hee cannot answer
saving as aforesaid.
To the 10th hee cannot answer.
To the 18th hee saith hee doth not knowe who are the freighters
of the Thomas Bonadventure, And otherwise hee cannot answer.
To the 21 hee saith that without all doubt rgere will be
losse in the lading and unlading of Cotton woolls and galls
though none of them be stolne.
To the 22 negatively for his part, and otherwise hee cannot depose.
To the 23th hee cannot depose.
To the 24th hee cannot answer.
Upon the rest hee us not interrogated by direction of the
partie ministrant.
Repeated in Court.
