The nineth of December 1659.
Examined upon the allegation of the 7th of January 1658
Captaine Willoughby Hanham commander of
this kentish and frigot in the immediate service
of this Commonwealth, sworne and examined
saith as followeth videlicet.
To the first, second, third fourth fifth sixth seventh and eighth
articles of the said allegation hee saith and deposeth that after
the seizure of the shipp the santa maria arlate and
as Captaine Stow was carrying her for Tolon this
deponent in the kentish frigot was then and
accompanied them to Tolon and in their passage
this deponent being aboard the fairfax first and
having much [?distresse] with John van lynon the
master of the said vessele the Mary (when this deponent
had before not in his [?use wards] preceeding off the
North Course), the
said John van lynen acknowledged then the lading
of the Saint Maria was taken in the Santa domingo
in the iland of his spaniola (which is the dominion
of the king of spainne) and that the said goods
consisting in Brazil wood, hides, and caccoa and
other goods were laded aboard her by spaniards. and
saith them were Hollander or others then such as are
spaniards or subiects of the king of spaine
are permitted to buy, sell or trade in the parts
of the west indies or to carry any goods thence
