there came the allate Vessell the May-flower whereof the allate Mr
White was Commaunder and was by the said White and Companie
moored and fastened to a Vessell whereof one Mr Walt was Commander
and having for some daies ridd so moored or fastned the said Walt
and Companie fetchd their Anchors aboard preparing to proceed upon
their intended voyage, and being ready to depart the said Mr Walt
in the hearing of this deponent and divers others did publiquely affirme, that
the said shipp the May flower lay too nere the said shipp the Margaret and
if Mr White did not take a care to moore and fasten her at a
further distance, shee would doubtlesse come fowle of the Margaret
and this deponent saith, That the said William White or some of his
Companie were severall times advertized thereof by the Company of the said shipp the
Margarett and particularly by this deponent but the said White and Company
neglecting the said advertizement upon or about the 6th day of November
1653. last past the said shipp the May fflower did really fall fowle of
the said Vessell the Margaret and broke her boltspritt and did her
some other dammage, and soone after the allate Robert ffoxe procured
the said shipp the Margaret to be viewed by shipp Carpenters and caused
a new boltspritt to be fitted for an putt into her to make her strong
and sufficient for her then intended Voyage for Virginia, The
premisses hee knoweth being as aforesaid Boateswaine of and belonging
to the said shipp the Margaret at such time as the premisses happened
and before and since. And further hee cannot depose:-/
To the 5th and 6th articles of the said Allegation hee saith and deposeth
That about the later end of the said moneth of November .1653
last, the said new boltspritt being putt on the said vessell the Margaret
the aforesaid Vessell the May flower did the second time by the
carlesnesse of the said White and Companie, and their neglect of
mooring their said shipp at a convenient distance, come fowle againe
upon the said shipp Margaret, and came athwart her hawse, by
which meanes the said new boltspritt was cracked, and rendred it
unserviceable for the intended voyage, so that the said foxe and Company
were constrained the best they could to repaire the same with [?f?XXXX]
and roapes, so that with great danger and difficulty they accomplished
their intended voyage to Virginia, and were there forced to putt
in another new boltspritt, so that this deponent is in Conscience
verily perswaded, that the said Benjamin Cranley and Companie
(did
