of ffeversham have for these twenty yeares last past (exclusive to all others whatsoever) bin in
possession of the sayd grounds as solely belonging to them and fished
them for their owne use and benefitt saving such trespasses as aforesayd And soe much
hee hath heard from aunchient men inhabitants of the sayd Mannor
and hundred of ffeversham to be Custome for them to doe and it to be publique and
notorious that they have soe done tyme out of mynde and memory of men now liveing
And saith hee never knew or heard that any ffishermen wither of
stroqde Gillingham Milton or any other but the ffishermen
tennants of the mannor of ffeversham did at any tyme store the
sayd grounds with oysters or fish quietly in them And further to this article hee cannot
depose./

To the second article of the sayd allegation hee saith that hee having
bin as aforesayd a ffisherman and a tennant of the mannor and hundred of
ffeversham for these 20 yeares last, hath observed that the tennants
of the sayd mannor and hundred have and doe yearely during the sayd
tyme watch upon the oyster grounds arlate from about Lamas
till about three weekes or a month after Michaselmas to prevent
any other persons but such as belonge to the sayd Mannor and
hundred of ffeversham from fishing for oysters on the sayd
grounds and saith it doth usually cost the sayd tennants ffishermen
of ffeversham Mannor and hundred thirty or forty shillings a
weeke and sometymes more for watching the sayd grounds,
And saith hee never knew nor heard that any of the
Inhabitants of Milton Gillingham or other places there
abouts or any but the tennants of ffeversham aforesayd did
at any tyme either watch uipon or pay for watching the sayd
grounds, or had or have any right soe to doe or to fish there quietly And further hee
cannot depose./

To the third hee saith his foregoeing deposition is true./

To the first Interrogatorie hee saith hee cometh to be a wittnes in ythis
cause and to testifie the truth of his knowledge therein being soe
required to doe by the producents and cometh without any
compulsion from this court and upon the charge of the producents
and saith hee is a ffisherman of ffeversham and useth to fish
