In the Name of God Amen I Phillip Williams now resident in Livorno being (thanks be to God) in perfect health yet knowing that all men and must die and being uncertaine when that time will come have thought fit to dispose of that [what?] estate which God hath pleased to blesse mee withall by this my last Will and Testament in manner and forme followinge.

First I give my body to the earth to be interred as opportunity shall admit and my Soule I humbly tender to God Almighty that gave it beseeching him of his infinite goodness and mercy to forgive all my sins and to accept of it through the xxite of his deare Sonne Jesus Christ the righteous as a pure and unspotted sacrifice being xxxxsed by his passionate sufferings.

And for such estate as God hath lent mee

IMPRIMIS I give and bequeath to my deare and loving brother William Williams in London Merchant six hundred pounds in money and my parts of the ships Margaret, Edward, Paramore, Retourne (or the quond:m Zant M:rchant) and the Casar which I value at about four hundredd pounds more.

ITEM I give and bequeath to my loving brother Daniell Williams my parte of the ships Sampson, Rainbow, Smirna Merchant and Northumberland which I value at about seven or eight hundredd pounds besides three hundredd pounds in money and besidesall such lands and tenements with their appurtenances as doo belong unto me in the parish of Roughford alias Rufford in the County of Yorke.

ITEM I give and bequeath to my loving brother John Williams the summe of eight hundred pounds to be paid him when he accomplishe the age of one and twenty yeares if he die before then my Executor hereafter named shall make an equal division of it amongst or betweene my unmarried brothers and sisters or if they shall be married then to my brother Daniell shall be paid three hundred pounds and to each of my married sisters living one hundred pounds apeece to bee paid them within twelve months after the day of his decease if my estate shallbee gotten in soe soone.

ITEM I give and bequeath to my deare sister Jane Garway two hundred pounds .

ITEM I give and bequeath to my deare sister Annie Williams four hundred pounds to be paid her at her day of marriage if my estate bee gotten in so soone else twelve months after my decease but I declare this legacie to be due to her but on Condition which is that she shall marry with the consent of my brother William Williams otherwise this legacie to be null and of no effect to her or her husband and if she be married before my death then shall bee paid her but five hundred pounds.

ITEM I give and bequeath to each sonne of my brother William Williams one hundred pounds and to each daughter of his fifty pounds .

ITEM to my nephew William Backhouse sonne to my sister Christian I give and bequeath one hundred pounds, and to each of her other children that shall be borne and living at my decease fifty pounds a peece.

ITEM I give to my neece Christian Riccard Daughter to my deare sister Katharine deceased one hundred pounds.

ITEM I give and bequeath to my neece (I think Christian) Garway daughter to my deare sister Jane one hundred pounds and my meaning is that all these legacies to my nephews and neeces shall be paid to the males when they accomplish the ages of one and twenty yeares and to the females at the day of their marriage, severally as they shall happen or when they accomplish the age of one and twenty yeares .

ITEM I give and bequeath unto the poore of the parrish of St Peter the poor in London tenne pounds .

ITEM I give to the poor of the parrish of St Andrew Undershaft in London tenne pounds and to Mr Henry Mason quondam parson of that parish ten pounds if hee be living.

ITEM I give to the two Compters S:t Tho: Hospitall in Southwark and S:t Barthlomews Hospitall in London twenty pounds that is to each one five pounds

ITEM I give to five poore widdowes of Ministers that have Children ten pounds to each one towards the binding of one sonne an Apprentice

ITEM I give twenty pounds towards the binding of two xxxx apprentices at the choice of my Executor.

ITEM I give to the Library of Sion Colledge in London to buy bookes ?ten pounds .

ITEM I give and bequeath three hundredd pounds to be disposed at the discretion of my Executor among such poore people as have beene impoverisht by the late civill warres in England.

ITEM I give and bequeath unto Mr William Garway, Mr Andrew Riccard and Mr Nicholas Backhouse my brothers in law to each of them thirty pounds in all ninety pounds..

ITEM I give and bequeath to my sister in law Mrs Jane Williams twenty pounds .

ITEM I give to my uncle John Watkin and my uncle Mr Richard Bishop ten pounds to each of them.

ITEM I give to my uncle Tobie Watkin all what he owes mee as I am one of my Fathers Executors and so I doe my Cousen Henry Robinson but what I have lent him hee shall pay my Executor .

ITEM I give and bequeath to my aunt Mary Kent five pounds and to her sonne John Kent now servant to my brother William Williams fifty pounds

ITEM I give and bequeath fifty pounds to be disposed of equally among the unmarried children of my Aunt Kent and my Aunt ?Jonas (xxxx wife for a parson in Northamptonshire)

ITEM I give and bequeath to my deare and lovely friend Mr John Collyer Merchant in London one hundredd pounds .

ITEM I give to my very good friends Mr Job Throgmorton Mr Nicholas Abdy Mr Thomas Barnsley Mr Henry Riley Mr Nicholas Penning Mr Samuell Bonnell and my cousen Mr William Garway oldest friend to S:r Henry Garway deceased to each of them twenty pounds a peece and hundred and forty pounds sterling besides ?blacks for mourning at the discretion of my Executor to those in London and of my assignee to those here

ITEM I give and bequeath to my Cousen Richard ?Lane thirty pounds desiring him to give in my obligation given him for a Ring I had of him for which I was to pay him twenty pounds at my returne to England.

ITEM I give and bequeath to Mr Humphrey Gyfford fifty pounds to his oldest sonne twenty pounds and to his second sonne tenne pounds .

ITEM I give to my Cousens John, William and Thomas Williams sonnes to my uncle Daniell Williams deceased tenne pounds a peece.

ITEM I give to John and William Gyffard sons to my mother in law deceased twenty pounds to each of them fourty pounds in all.

ITEM I give mourning to Mr Collyer too at the discretion of my Executor.

ITEM I give and bequeath to Mr Edward Beale Merchant at Messina twenty pounds and mourning desiring him to accept of my Cousen Thomas Garway (now with me) for his servant whith (sic) whom he shall have five hundredd dollars and his service as an apprentice five yeares and I farther intreat him that as he findes the young man capable to instruct him in such business as he leaves when he departs from Messina.

ITEM I give to my Cousen Robert Sainthil Esq:r ten pounds and to his wife Mrs Elizabeth Sainthill ten pounds.

ITEM I give to my loving friend Mr Francis Greene sixty dollars peeces of eight rialls.

ITEM I give and bequeath to my two servants Tho: Hetherington and Richard ?Groves ten pounds to each five pounds .

ITEM I give and bequeath to my Servant and Apprentice Thomas Payne sonne to Thomas Payne Esq:r of the Middle Temple at London one hundredd pounds of the two hundredd I had with him and I devise my brother William Williams to looke after his breeding as I shall doe if I live hee's a willing lad and capable and I intended he should in his time succeed in this my business at Livorno, which I devise may come to passe if he bee hereafter willing .

ITEM I give to Mr John Foyle for a token of the good service he hath done and fourty pounds sterling and if I die in Italy in Italy or before I alter this my Will and Testament I desire him to see my estate gotten together that now is abroad in adventures which noe man knows so well as hee and to render of it a just Acc:t to my Executor for which paines taken I give him three hundredd dollars beside the full moiety of such provisions as shall aside from the sales of all such goods as are unfold at the day of my death whether in my warehouses or upon the way in

Ships so as they are consigned to mee I say a full moiety or halfe of ?cleare & provisions all necessary expences of house ecr: being first discharged and for disposall of my business such as is consigned by any particular man to M:r Green and mee joyntly I desire may be holy at M:r Greenes disposall and the provisions all his but if any xxxx of our friends have joyned us in Commission I desire M:r Greene may have but his ordinary share of such provisions as may arise from such consignments and that the rest mya bee added to what concerns my particular imployment and estate and be divided equally between my two assignes which I nominate to be M:r John Foyle and my brother Daniell Williams if he arrive here in time and the other halfe or moiety of ?cleare provisions arising from the sales of such goods as mya bee consigned mee I allow to my brother Daniell desiring him to bee assistant to M:r Foyle in the recovering in of my estate and both of them to live lovingly together and if it please my friends to continue their employment to them I doe intreat them to bee mindfull of Thomas Payne and not suffer him to loose the relation hee hath (in my thoughts and intentions) to this businesse in future

ITEM I give and bequeath to my loved and deare friends M:r Edward Consull at Aleppo and M:r Thomas ?Berkley at Constantinople thirty pounds to each fifteen pounds

ITEM I give and bequeath to my good friends M:r Robert Abdy M:r John and M:r Edward Digges M:r Edward Langham M:r John Lewis at Genoa M:r William ?Reymes M:r Morgan Reade and M:r Nathaniell ?Duiant at Smyrna, to each of them ten pounds to buy a Ring n my remembrance

ITEM I give and bequeath to M:r Thomas ??Penoyer (or ??Beyer) Merchant in London twenty pounds

ITEM I give to Cap:t Thomas Davis Cap:t Elias Jourdan Cap:t Tho: Freshfield and Cap:t Nicholas Hulsetone (sic) to each five pounds to buy a Ring

ITEM I give and bequeath to my quondam friend M:r John Lancelott (now possessing the title of ?Agent at Conp:le) five pounds and noe more

ITEM I give and bequeath to M:r John Fairfax M:r John Wright M:r Charles Longland M:r Henry ?Benyer M:r James Man John Hunt and M:r Edward Rolt five pounds to each of them and to M:r Samuell Rogers Minister now with mee five pounds

ITEM I give to my very loving friend M:r Richard Bogan junior now at Pisa ten pounds

ITEM I give and bequeath to S:r Richard XXXent Kn:t and Bar:t now resident at Paris for his Ma:tie my lesser Diamond Ring cut in??sasoles enamelld with black

ITEM I hearby declare that in case my ??imminent losse should come or fall upon my estate either by Sea or land (whereof the meanes should not arrive till after this my Will be ended) Each legacie herein given that passes the summe of thirty pounds shall bee liable to beare in equall and ratable proportion of such losse bee it more or lesse excepting onely such legacies that are intended to a charitable end of relieving impotent or inpoverished persons: And farther that each legacie ??named to bee so many pounds is to be understood soe many pounds sterling each pound ster consisting of twenty shillings English money though I desire that any persons abroad that is here at Livorno who demands his legacie may have it paid him in peaces of eight rialls valuing each peece of 9/9 at fifty two pence Sterling or four shillings and two pence

ITEM I give and bequeath to Cap:t Jacob Hyde five pounds for a remembrance and I desire my Executor here after named to dispose of one hundred pounds if he think fit among such friends as I may happily here have forgotten too (sic) name or as much of that summe as he pleases I also declare that it is my Will and desire that the provisions of all goods sold (that were consigned to mee) to the day of my Death, bee made good to my estate and Acc:ts rendered accordingly And that whatsoe xxx goods unsold that are consigned to mee and M.r Francis Green by any particular persons, and not and joynt ?Comp:lt may to M:r Green yeeld their full provisions on their sale and that my Assignes have nothing to do with there or theire ?proceeds. And all the abovenamed legacies I desire my Executor hereafter to be faithfully discharged//

And paid within twelve months after my decease to all those that have longer limitt and that are loving at the day of my decease For I hereby declare that noe legacies above named shall be due to any Executor xxxx the legatee more liveing at the day and time of my decease

ITEM I give and bequeath to each of my brothers and sisters and brothers in law and sisters in law as well herein named as not named blacke for mourning and to all such English servants or friends as belong to and xxxx in my bank (sic) I give mourning which blacke must be ordered at the discretion of my Executor at London and of my Assignes in Livorno. Also I give to every Englishman that accompanies my body to the grave a paire of white gloves and a ribbon And I doe hereby make ordaine institute and appoint my deare brother William Williams sole Executor of this my last Wil and Testament desireing his care in performance and for his paines as Executor I give him all the advance of my estate herein not disposed beseaching God of his mercy to blesse it to him and him and his with that eternall life which I now and always pray for And thus I end my last Will and Testament contained in two whole sides and also xxx a third side of a sheet of paper written all with my owne hand and twice interlined by nee (vizt) xxxx from the top and eighteen lines from the bottome of the second side subscribed and my seale put to it with my owne hand the fifth day of March 1646 Novo or Roman style in Livorno.

Witnes hereto in presence of whom it was sealed and subscribed John Pxxxx William Freeman.

IN THE NAME OF GOD AMEN I PHILIP WILLIAMS (though weake of body yet of perfect understanding) doo hereby add to a former Will written all with my owne hande in the month of March 1646 I say one thousand six hundred forty and six a true Coppy whereof under my owne hand also rests in the hands of my deare brother William Williams but my condition since that time being much altered I make this Schedule to correct and amend what else must xxxx bee extravagant.

My body I desire may be interred neer Livorno where the English lie buried My soule I humbly beseech God its Maker to accept as unspotted sacrifice being purified by the blood and merits of my deare Saviour Jesus Christ.

The estate it pleases God I have when my debts are first satisfied and my servants paid xxxxxx not contradicting ought in my Will whilst there remaines sufficient xxxx good those legacies there given those that concerne Charity I would have first satisfyed. Then I give and bequeath to my loveing wife M:rs Dorothy Williams so much more as shall make her third three thousand pounds sterling if my estate should not hold out to make it more otherwise her full third and all my plate such of my householdstuffe as she will take to her selfe with all such jewells as she hath worne here and God Almighty blesse her with them.

ITEM I give to my brother William Williams one thousand pounds and a great Diamond Ring now in his possession.

ITEM I give to my brother Daniel Williams all my lands in Yorkshire.

ITEM I give unto my brother John Williams five hundred pounds.

ITEM I give to my sister Christian Backhouse and to my sister Jane Garway to each of them fifty pounds and to every of their Children twenty pounds a peece

ITEM I give to my brother William Garway thirty pounds and to my brother Andrew Riccard thirty pounds.

ITEM I give to my brother Nicholas Backhouse twenty pounds and to my brother Edwin Browne twenty pounds.

ITEM I give to my Cousen Robert Sainthill and his wife and my cousin Nicholas Penning M:r Henry Ryley M:r Richard Bogan junior and divers others not here named such legacies as are in that Will designed them and to M:r Theodore Reade if he be not in that will twenty Dollars and to my wifes//

Maide Mary Poole fifty Dollars and to all my house mourning To my Lord Ambassador S:r Thomas Bendish his Lady and all their children mourning what I forget here I devise my Executor would supply according to the terme of my will. To M:r William ?Reymes besides his legacy in my Will when he hath finished the ballancing of my bookes I give such a reward to him as shalbee judged fitting by M:r Thomas Forster. As for my estate I can make noe certaine judgement of it because it depends upon the interest I have in England joyntly with my brother William Williams. There is a dispute of two thousand dollars resting between M:r Francis Reade and me which is passed in M:r John Fairfax his bookes and M:r Barnsely told mee the day that he made his Will and oftentimes before that he was to make mee good the money only he desired that I would dispute the case that soo the interest of the money might be saved to: I owe to M:rs Samuell Bonnell for the dyett of my selfe and my wife and our attendants from the p:mo of November 1647 to the eleveanth of July 1648 which he is to xxxx and in acknowledgement of his great favour and and courtesie to mee in that time of my necessity besides his legacie given in my Will I present him with a peece of Plate of fifty dollars at his election that may rest by him continually to testifie my gratitude not equall to his kindnesse

ITEM I give to Doctor Peake’s widdow one hundred Dollars.

ITEM I give to M:r Nath: Durant one hundred Dollars.

ITEM I give to M:r Samuell Rogers one hundred Dollars. My Assignes at Livorno I appoint and ordaine to be Francis Green of whose fidelity and affection I have had sufficient experience and I desire my Executor that he would continue those affections towards this my assigne as have inhabited the thoughts of his most affecctionate and observant brother.

ITEM I recommend John Batten to the care and education of Francis Greene desireing that the two hundred pounds which I intended to have had with him of his father may be paid to the said ?Greene XXXX the seventh day of August 1648 My desire is that Richard Nicholas may be looked upon by my brother William Williams and imployed as occasion shall present Phillip Williams Subscribed Sealed and delivered in the presence of us Edward Langham William Langham In Consideration of extraordinary allowance I made XXXXX for one to assist him I doo further order that out of the estate of said XXXXX resting in my hands be forthwith made good to William Reymes before menconned after the rate of four hundredd Dollars p annum from the time of his coming to the s:d xxxx untill the said ffoyles death being three years which is for sallery and dyett I give to Martin Lister thirty dollars for a legacie Idem Phillip Williams
