thence to Leghorne, and from thence to Gallipoli and laded oiles and
returned therewith for London where she came to an anchor in lower
Shadwell neere Bell wharf about ffive or six weeks since. And saith
that from Plymouth she carried a lading of pilchards (six hundred
hogsheads) to and delivered them at Leghorne according to consignation to one
Mr James Gold the arlate Golds factor there. And saith that when she
soe went from Plymouth she was an old shipp, some part of her
upper worke untrimmed, and he pumpes not fitted as they should bee
And by reason of the defects of the said shipp and stresse of weather
then happening neere the Northern Cape the goods and lading of the
said shipp received dammage by the waters running into the hold
amongst them. And saith that had the upper workes of the shipp bin trimmed
and she fitted as she ought to have bin hee beleeveth that the
dammage might not have bin soe great as it was, And saith
the Company did not in the least neglect their duties their lives as
well as goods being hazarded by reason of that storme and the violence
thereof. And saith that hee assisted in the unlading the goods in
question and beleeveth and knoweth that some of the goods were
damnified, but how many or what quantity of them not seeing the same opned or what
the Merchants have suffered he knoweth nor cannot estimate, Et alr
nescit.

Elias Beake de London mercator aetatis 50 aut
circiter testis produit et juratus.

Ad primum et 2 arles deponit et dicit that hee well knoweth the
producent Samuel Beake who is his kinsman namelie his brothers sonne
who he saith is an Englishman borne in the parish of Saint Buttolph
Billingsgate and here educated by his father Arnold Beake his
precontest and resident in Bordeauz as a merchant stranger and a
ffactor, and a boarder being a Batchelor, and one that drives a
very considerable trade in merchandizeing affaires as well in
shipps as goods and to that purpose and for the carrying on or his
said trade hee keeps his factors at Rochell and other places in ffrance
as also in Corke and Dublin and other places in Ireland. And hee soe trades
for his owne account and adventure which hee knoweth y the frequent
receipt and advise by his letters and thereby being made privy to
such his negotiations being his ffactor with his the said Samuells father
and brother here in London And is a subject of the [?XXXX]
the King and for and as a great trader in salt wines and other
Comodities of ffrance for his owne account and a Merchant of good [?XX]
