To the 6th hee saith the said [?harwar] Rankin was and is commonly
accompted a scotchman by birth and a Marchant of Edinbrough
and a dweller there and a subiect of this Commonwealth, And
otherwise hee cannot depose

Examined upon the sayd allegation/

Rp. 2.

David Stock of Kerkcaudie in Scotland Mariner Master of the
sayd shipp the Peter of Kerkcaulde aged twenty two yeares
or thereabouts a witnes sworne and examined saith and deposeth
as followeth videlicet./

To the first second and third articles of the sayd allegation and the schedule
in the sayd second article mentioned hee saith and deposeth that hee well knowes
the arlate Rankin, and hath knowne him for these five yeares last past, during
which tyme his residence of him and his family hath bin at Edenburrough in Scotland
of which Kingdome (hee is reputed to bee a native) and saith hee hath well knowne the
shipp the Saint Peter arlate ever since the sayd Rankin bought the same at haverdegrace
in ffrance, which was about the beginning of the moneth of July last 1655 English
style and saith hee was oresent and privie to the treatie betwixt the sayd Rankin
and one Monsieur Pape a Scotch Merchant living at haverdegrace touching the sale
of the sayd vessell and her provision on board her by him the sayd Pape to the sayd Rankin, and saith hee was not
present at the signing and sealeing of the bill of sale made by the sayd Pape to the
sayd Rankin for the sale thereof, but beleeveth such a bill was made for that hee
this deponent was by the sayd Rankin made Master of the sayd vessell at
haverdegrace, and had the sayd bill of sale committed by the sayd Rankin to the
Custodie and keepeing of him this deponent who had the same aboard the sayd shipp
and in his this deponents custodie when the sayd shipp was seized in mannder hereafter
declared, And saith from the tyme of the sayd bill of sale being made, which was
about the beginning of the moneth of July, the sayd Rankin was Commonly reputed
the true lawfull and sole Owner and proprietor of the sayd shipp the Saint Peter and
of all her tackle apparrell furniture and provisions on board her, and as
sole and true Owner of her, did constitute this deponent Master of her for the voyage
in question, and his Contest John du Sell Pilott of her for the same, which voyage
hee saith was to have bin from haverdegrace to Rochell, where shee was to have
taken in a ladeing of salt, and to have gone thence with the same to the Bancks of
Newfound land to lade ffish and returne therewith to Plymouth ir dover and there
expect and attend such further order as the sayd Ranckin shoukd then thinke fitting
this hee the better knoweth being Master of the sayd shipp, and having such order
in writng as is predeposed given him by the sayd Ranckin before the sayd shipp sett
sayle from haverdegrace, And having receaved such order the sayd shipp sett sayle from
haverdegarce upon the 8th of July aforesayd English style and 18th of the same moneth new style,
and in her course thence towards Rochell being come out to sea shee was the next
day after such her departure from haverdegrace met with at sea and seized
by the Portsmouth ffrigatt (Captaine Sanson Commander) in the imediate service
of this Commonwealth, and by his order brought into Portsmouth, this hee knoweth
being master of the Saint Peter aforesayd and aboard her at the tyme of her seizure
and being sent in her as a prisoner to Portsmouth aforesayd, And further hee cannot
depose saving hee saith hee was not present at the payment of any money by the sayd
Rankin to the sayd Pape for the sayd shipp and provisions, but knowetyh that
by the treatie which hee was present at, it was agreed that the sayd Rankin should pay
the sayd Pape for the sayd shipp and provisions fower thousand five hundred
Livers Tournois, and beleeveth the contents of the bill of sale arlate soe seized in
this deponents Custodie to be true, and all things soe had and done as therein is
expressed./

To the 4th and 5th articles of the sayd allegation hee saith that the sayd shipp
