The 25th day of May .1653 [CENTRE HEADING]

Examined upon the sayd Allegation.

Antonio Ala Rosa of Sevill in the Kingdome
of Spayne Mariner. aged two and thirty
yeares or thereabouts, a witnesse sworne
and examined, deposeth and saith as
followeth.

To the first article of the sayd allegation he deposeth and saith that
the arlate Lewis ffernandez Angell, whom this deponent hath known
for these fifteen years and upwards, in the tyme arlate
and before videlicet in the monethes of Juyly August September October
and November 1652. and att this present was and is the true and
Lawfull Owner of the thirteene barrs of Sylver arlate, marked
in manner following, that is to say seven of the sayd barrs of sylver

marked with the first marks in the margent, five more of the sayd
barrs with the second marke in the margent, this deponent knoweing that the

[SECOND MARKE, LH MARGIN]

sayd barrs of plate or sylver came in a shipp of the West India
Spanish ffleet which arrived at Cadiz in July aforesayd and
after the arrivall thereof being delivered to the sayd Lewis
ffernandez the produrent in the bay of Cadiz aforesayd where
this deponent saw him in the quiet and peaceable possession thereof
And further he cannot depose saving that the sayd produrent is
commonly accounted and reputed the rightfull owner of the sayd barr [of]
sylver

To the second article this deponent saith and deposeth that he this deponent
being aboard the arlate shipp the Sampson about the latter end of
the month of July aforsayd newe stile, saw the sayd Lewis ffernandez
Angell accompanied with this deponents Contest Don Antonio da [P?XXX}
bring on board the sayd shipp Sampson the arlate barrs of sylver in a [?XXXX]
as is predeposed, and delivered the same to the Purser of the sayd
shipp to and for the proper Accompt of him the sayd produrent
to be transported to the port of Ostend in fflanders there to be
delivered likewise to the sayd produ[c]ent for his owne account
this deponent being then aboard and observing and well remember[ing]
the passaged betwixt the sayd produrent and sayd purser and saw
the sayd purser deliver to the say Lewis ffernandez a note or Receipt
of the sayd sylver to the effect now deposed. And further he cannot
depose saving that having now for many years knowne the sayd
produ[c]ent and the manner of his trade and dealing did never [observe]
or know that he ever dealt or delivered goods for other persons but [?he]
from tyme to tyme dealt with and mannaged his owne proper goodes
in the way of trade.

To the third Article this deponent saith that after the lading of the sayd
sylver as aforesayd and more particularly about the tenth or [elevenenth] [of]
September last new stile the Purser of the sayd shipp the Sa[mpson]
named Pedro signed and firmed with his owne hand three bills [of]
lading for the sayd thirteene barrs of sylver all of one tenor
