The eighteenth day of August 1653. [CENTRE EHEADING]

Examined upon the sayd Allegation

Antonio Estevan de Balderas borne att
Madrid in Spaine an Inhabitant of Limma
in the West Indies Merchant aged thirty eight yeares or thereabouts a witnesse sworne and
Examined deposeth and saith as followeth
videlicet.

To the first Article of the sayd Allegation this deponent saith and deposeth that in
th emonethes of August September October November December
January and ffebruary and March 1652 the arlate John de Losa Barona
was and att this present is the true and lawfull owner of all and singular
the money plate and sylver mentioned in the three schedules to the
allegation annexed and hereafter more particularly deduced, And this
deponent saith that the sayd producent is a merchant of good quality
and in his howse att Limma in the West Indies this deponent sawe him the arlate
John de Losa Barona in the quiet and peaceable possession of the sayd
moneyes and plate, and knoweth that he brought the same with him
from Limma aforesayd to Cadiz in Spaine where he likewise had the
quiet possession thereof. the premisses this deponent knoweth to be true being
one that assisted the producent in the bagging and telling of the money
and putting upp the plate arlate att imma, and coming along with the sayd
money and plate in Company of the producent and his precontest Juan
Mexia de Herera from Limma to Cadiz aforesayd. And for lawfull Proprietor
of the sayd money and plate schedulat the sayd producent is reputed and
taken. And further he cannot depose.

To the second he saith and deposeth that within the tyme arlate videlicet about the
latter end of September 1652. teh sayd John de Losa Barona by his Agent
Nicholas Caraso Dias assisted by this deponent and one Thomas Sanchez
Deressa att Cadiz aforesayd for his owne use Account and Risco did lade
and put aboard the sayd shipp the Saint George John Martinsdorp master or
Captaine, all and singular the money and plate mentioned in the first
schedule
