her proceede on such voyages out of the River of Thames and
retourne thither under the conduct of the said Stephens as master thereof, and
that hee is nowe preparing (as this deponent hath bin informed) to goe to sea
with her againe, and this deponent hath seene him the said Stevens
receiving goods aboard her for ffrance, and hath seene him dischardge goods out of
her at Smarts key which hee as this deponent beleevth hath brought from ffrance. And otherwise
hee cannot depose.
To the fifth and 6 hee cannot depose, but verily beleeveth that the said Coleman
did never make over or any wayes transfer his interest in the said two thirds
of the said shipp to the said Stephens, which hee beleeveth having heard the
said Coleman seriously averr that hee hath not soe transferred the same,
and the said Coleman still retaining his proprietie in the said two third parts,
this deponent conceiveth that the said Stephens ought to be accomptable to
him for the Proffits thereof.
To the 7th hee cannot depose, for hee saith hee did not knowe the said shipp
in the moneth of ffebruary 1652.
To the 8th hee saith that the said Stephens doth keepe whole possession of the
said shipp, and albeit hee hath bin requested and required by this deponent
and others to deliver the possession of the said Colemans two thirds to him
the said Coleman, and an accompt of her proffitts, hee the said Stephens
hath denied and refused soe to doe, and soe doth refuse at present.
And otherwise hee cannot depose.
To the nineth hee saith that hee hath heard the said Stephens about a yeare
and halfe since being with this deponent at
the signe of the Carpenters armes at Redriff, and there in speech of
the said shipp and the said Colemans proprietie therein, and alsoe
elswhere, confesse and say that the said shipp was not condemned
or adiudged as prize in any Admiraltie Court in ffrance, nor any
Sentence therein given against her. And otherwise hee cannot depose.
