“I Sir Joseph Ash of Twittenham (sic) in the County of Middlesex Bar:t”

“my body to be decently and privately buryed in Twitenham (sic) Church”

“I give and bequeath unto my deare and beloved Wife Dame Mary Ashe All my personall Estate bothmoney debts chattells jewells or of what nature soever only charged with my Legacies Debts and ffunerall expences”

ITEM I give and bequeath to my said Wife Dame Mary Ashe All my Mansions Lands Tenements and Hereditaments in Yorkeshire or Wiltshire or elsewhere in England whereof I or any othe rperson or persons stand or ought to be seized to my use To have and to hold the same to the use and benefitt of her selfe and her heires untill shee shall dispose there of or any parte or partes thereof according to the trust and confidence in her hereafter expressed without any account of the rents issues and profitts thereof And the trust and confidence which I inxxxx and intend is this as followeth and not other or otherwise That is to say That shee have power and authority by deed or deeds to give or convey such of the premises to my sonne James Ashe or any of my children or for their benefitt or advancement for such estate or estates in fee or in tayle or otherwise and on such terme or termes as shee shall think fitt freely and without compulsion in Law or Equity to doe but only as aforesaid at her owne will and pleasure And further That for soe much of the said Lands Tenements and Hereditaments which shee shall not have formerly and fully disposed by Deed of Deeds as aforesaid shee hath and shall have power and authority by her last Will in writing to dispose thereof to the person or persons aforesaid in manner aforesaid and at her will and pleasure and what shall not be by Deed or Will soe disposed of the same shall come and be conveyed to my heir or heires which shall soe be at the time of her death I desire and will that my sonne James Ash be paid by my wife out of the rents of my reall estate an Annuall sume of one hundred pounds p Ann ill hee is sixteene yeares of age and two hundred pounds p Ann afterwards And whereas two of my daughters Anne Ash and Martha Ash are not yet disposed of in marryage my will is and I doe hereby appoint that my Executrix out of my personall estate within six months after my decease pay unto my daughter Anne Ash the sume of seaven thousand pounds and interest for the same from my death and till the money be paid ar the rate of five p cent And to my daughter Martha Ash my will is that my Executrix pay her seaven thousand pounds within twelve months after my decease and interest at five p Cent untill the money be paid both which sumes are in lieu of their porcons And I doe make my deare Wife Dame Mary Ash my sole Executrix and Guardian to my sonne James Ash

And I doe hereby annex a Schedule of what Legacies I would have paid

A Schedule of Legacies which I doe order to be annexed to this my last Will and Testament

ffirst I give to my Lord Townsend one hundred pounds for mourning

ITEM I give to William Windham of ffelbrook [or Holbrook] esq. One hundred pounds for mourning

ITEM I give to my Brother Samuel [TBC] Ashe Twenty pounds for mourning

ITEM I give to my Sister Boyer tenne pounds for mourning

ITEM I give to my Daughter Anne Ashe as a further augmentacon of her porcon of seaven thousand pounds five hundred pounds which with the five hundred pounds or thereabouts may be due to her my will is that my Executrix shall take both the sumes of the two ffive hundred pounds and of the seaven thousand pounds and continue to her at Interest as is specified in my Will.

ITEM I give in charitable uses the sume of eight hundred pounds Viz:t One hundred pounds to the Trustees of the Schoole of Xownton ffifty pounds to the Poore of the Parish of ??Wappin?? and fifty pounds to the poore of the parish of Twittenham cheifly to put out Children to be prentices

ITEM I give to the ffrench Protestants the sume of an hundred pounds in such manner and season as my Executrix shall think fitt and expedient The rest I give amounst (?] our poore relaions (sic) as shee shall judge to be in greatest want And in case my sonne James should dye without any issue then my will is that my Executrix shall pay unto the eldest sonne of my Brother Samuel Ash three thousand pounds and two thousand pounds more to be distributed amongst poore relaions

ITEM I give to my good friend S:r Josiah Child Twenty Guineys for his kindnesse

ITEM I give to M:r William Sedgewick Tenne Guinneys for a remembrance If Xarron should tarry a yeare after my decease to have tenne pounds for the last yeare allowed him And that shee will be kind to the rest of my servants as they deserve
