the Company of the John they called out to the &amp;amp;#91;m?&amp;amp;#93; and &amp;amp;#91;Company?&amp;amp;#93;&lt;br /&gt;
of the Mary rose to let fall an anchor to stop their ship which&lt;br /&gt;
they heard and replyed that they could not tend to &amp;amp;#91;starken?&amp;amp;#93;&lt;br /&gt;
their sailes nor let ship an anchor or to that effect, and would&lt;br /&gt;
not nor did &amp;amp;#91;Xither?&amp;amp;#93; but, still kept on their Course through they were&lt;br /&gt;

used their best endevor to get her off, which hee saith came&lt;br /&gt;
and happened by the carelesseines or wilfullnes of the said&lt;br /&gt;
Cole and Company for had they slackened their sailes&lt;br /&gt;

lading, which deposeth for the reasons aforesaid&lt;br /&gt;
Ad 8a dirit that the said ship at the time of her said sinking&lt;br /&gt;
in this deponent judgement who hath used the sea &amp;amp;#91;?&amp;amp;#93;&lt;br /&gt;
was worth the sume of One Thousand pounds sterling or&lt;br /&gt;
thereabouts, and the said 140 chaldron of Coales Newcastle&lt;br /&gt;
measure would here have yeilded had they bin brought hether&lt;br /&gt;
safe (as in all likelihoods they would had not the said disaster&lt;br /&gt;
happened) the sume of 240 sterling or thereabouts etate nefrit&lt;br /&gt;

care, and at great cost and charges did peserve about 112&lt;br /&gt;
Chaldron of the said Coales out of the said ship which were&lt;br /&gt;
 very wet and much &amp;amp;#91;?&amp;amp;#93; by lying under water, but&lt;br /&gt;
&amp;amp;#91;?&amp;amp;#93; the same were sold for hee knoweth not, and they alsoe&lt;br /&gt;
at great Costs and charges did weigh up the said ship John&lt;br /&gt;
but the same by reason of her sinking and lying under water&lt;br /&gt;

A 3.4.5 et 6 dirit that upon or about the 22th day of October&lt;br /&gt;
1658 the said ship &amp;amp;#91;wrighed?&amp;amp;#93; to come out of the river of&lt;br /&gt;
Newcastle and shee was then coming out in Company of&lt;br /&gt;
a great ffleete of ships, most of which were aboard of the&lt;br /&gt;
John, shee then having about 14 chaldron of coales, Newcastle&lt;br /&gt;
measure onboard her and the wind being to this deponent&lt;br /&gt;
remembrance  West North West neere that point, the&amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
Robert Marriot which was &amp;amp;#91;master&amp;amp;#93; of the John caused his&lt;br /&gt;
Company &amp;amp;#91;?&amp;amp;#93; of this deponent was one to &amp;amp;#91;?&amp;amp;#93; saile&lt;br /&gt;
to prevent the Johne Coming foule of some or one after&amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
ships of the said ffleete.&lt;br /&gt;
and to the and shee should not take away their winde&lt;br /&gt;
and saith that im diately after the John weighed &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
out of the said River, foresaid ship Mary Rose &amp;amp;#91;?&amp;amp;#93;&lt;br /&gt;

Ad 2 dirit that the deponent hath seene a bill of sale in the&lt;br /&gt;

which the Carpenter of that built the said ship made to him for her&lt;br /&gt;
but weather it was soe or not hee knoweth  not, hee not&lt;br /&gt;

ship in a Considerable sume of money, to save&lt;br /&gt;

the lilate John Martin was master of the lilate ship the&lt;br /&gt;

comonly amounted to be a part owner of the said ship, and&lt;br /&gt;

ship by Consent of her owner et ate nefrit saving the said ship&lt;br /&gt;

1658 the said ship the Tymothy arrived in the River&lt;br /&gt;
of Newcastle, this deponent being then carpenter of her, and&lt;br /&gt;
the same Martin the &amp;amp;#91;master&amp;amp;#93; of the said ship did then want and&lt;br /&gt;
stand in need of money to buy Coales to lade the said ship&lt;br /&gt;
and alsoe to buy provisions for her Company, and the&lt;br /&gt;
said Martin being in &amp;amp;#91;?&amp;amp;#93; want did repaire &amp;amp;#91;?&amp;amp;#93; the lilate&lt;br /&gt;
John Taylor of Gateside aforesaid, and acquainted him there which&lt;br /&gt;
and &amp;amp;#91;intrated?&amp;amp;#93; and &amp;amp;#91;importxxxx?&amp;amp;#93; the said Taylor, in this deposeth&lt;br /&gt;
pefeure and hearing to be ayding and assisting to him the&lt;br /&gt;
&amp;amp;#91;?&amp;amp;#93; Martin in the borrowing of forty or fifty pounds to helpe&lt;br /&gt;
to buy provisions and Coales lade the ship, and thereupon&lt;br /&gt;

fifteene or sixteene Gunnit at the Golden Starr. &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
tare and doe mure pejudire to her saithe, and &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
and a small &amp;amp;#91;?&amp;amp;#93; &amp;amp;#91;?&amp;amp;#93; was in Company and belonging to the &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
fired two or three gunns at the Golden Starr &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;
then in the hull, and saith that the said shooting &amp;amp;#91;GUTTER&amp;amp;#93;&lt;br /&gt;

of the John and Katherine, the Coast ffrigotts, Topsailes&lt;br /&gt;
were half mast downe, lying at the mast, and her&lt;br /&gt;
foresaile halfe up in the Brayles ; and her Boate&lt;br /&gt;
was towing her to the northward: And saith at the time&lt;br /&gt;
the said damage was done this Deponent could not perceive&lt;br /&gt;
that the Coast ffrigot had ever an anchor downe, The&lt;br /&gt;
Premisses hee deposeth being the said time Boatswaine&lt;br /&gt;
of, and on board the said Ship John and Katherine and&lt;br /&gt;
Sawe, the premisses acted and done as aforesaid&lt;br /&gt;

and before and since the lilate John Miller was the master and part owner of the&lt;br /&gt;
ship the john and katherine and soe commonly accounted&lt;br /&gt;
which hee knoweth for that hee belonged to the said ship&lt;br /&gt;
about two or three monethes before the damage in question.&lt;br /&gt;
happened and  hath belonged to her ever since, and further cannot depose.&lt;br /&gt;
to the second hee saith that by the relation  of the Company&lt;br /&gt;
of the coast ffrigot Libellate, the Lilate Elliot and Risby&lt;br /&gt;
 were on board the said ffrigot at the time shee did the&lt;br /&gt;
Damage to the John and Katherin as hereafter is (? expe)&lt;br /&gt;
but which of them was master of her then hee knoweth&lt;br /&gt;
not; but saith that the said Risby went from Gravesend&lt;br /&gt;

To the third and fourth positions hee saith that in the said&lt;br /&gt;

Gravesend, in safety in a Convenient place where&lt;br /&gt;
