And saith That it is notorious That the said shipp being in her
Course from Cadiz towards Dunquirke was surprized and taken by
some of the shipps of this Commonwealth, the said peeces of eight
then being as hee verily believeth, in and aboard the said shipp And
otherwise cannot depose.

To the last hee saith his foregoing deposition was and is true

To the first negatively.

To the second hee saith hee hath personally knowne the interrate Edward Peters
for about 6 yeares last past, and the said Gerrard Ryper for
about 7 yeares last by Correspondencie. And otherwise cannot depose.

To the third hee saith hee was not at Cadiz at the time of the lading
of the Patacons[?] interrate, And otherwise cannot depose.

To the 4th hee saith the interrate Edward Peters is an Antwerp
borne and hath lived there in the Kipdorp street and other streets in Antwerp with his family
over since this deponent know him, and formerly for severall yeares
lived at Dover in England, and the said Gerard Ryper is also an
Antwerper borne, and hath lived in Cadiz for all the time this
deponent hath knowne him by Correspondencies as aforesaid and
is there married.

To the 5th and 6th hee saith hee was not present at the signing
of the bills of lading interrate, And otherwise saving his
foregoing deposition hee saith hee cannot depose.

To the 7.th hee saith by vertue of his oath hee beleeveth the
bills of lading predeposed to be reall and true, and no waies
fictitious false or Colourable. And otherwise cannot depose.

To the 8. 9. and 10.th hee cannot depose.

To the 11th hee saith hee is for the reasons predeposed fully
Convinced in Conscience that the patacons [?] now Claimed doe
really and truely appertaine to the producent aforesaid, and to no other
person or persons whatsoever and that the said shipp and lading
were directly bound for Oastend or Dunquirke, and no other part or
place whatsoever.

To the 12. and 13th hee saith, That hee very well knoweth by the
sight and perusall of the [reciprocals] letters of advise which have
passed between the producent and his said ffactors that Order
was sent from Antwerp to the said ffactors to lade moneys and
silver upon all free shipps coming from Cadiz to fflander for the
said producents accompt, in part of returne of the said producents

To the 7th hee saith by vertue of his Oath That the bill of lading predeposed sent over land from
Spaine to the producent at Antwerp, and from theure to Mr. Rishoult his
Correspondent here, and the duplicat thereof remaining in this Court, were and are,
as hee in Conscience firmely beleeveth true and reall bills of lading made according
to the verity of the matter, and no way fictitious or Colourable.

To the 8th 9. and 10th hee knoweth nothing thereof.

To the 11th hee saith hee doeth not knoe neighter doeth hee in Conscience beleeve
That the [Pacacons] now Claymed or any part thereof, doe belong to any
Subject or Subjects of the King or States interrate, nor that the said shipp
was designed for any other place then Dunquirke.

To the 12. and 13th hee saith That the said producent of this deponents Certaine
knowledge gave order to his said ffactors by severall letters of advise sent before
the lading of the [Pacacons] in question to lade money and plate for his accompt in all such free
shipps as should come from Cadiz to Dunkirke or Ostend, And otherwise cannot
depose.

To the 14th hee saith That the said Gerard Ryper had severall goods and effects
in his hands of the said producents, forasmuch as the said producent by John
de Vos in his shipp the ''Saint John Evagelist'' and by ffoppe Wessell [au]
Ostend had in the moneths of ffebruary and March 1652 sent from Ostend
severall fflander wares and merchandizes to the valew of about 24 000 gild.XX
part whereof was consigned to the said ffactors besides the [remained] of severall
effects formerly sent him from Ostend.

To the 15th negatively, saving hee understood by the said ffactors letters, that the
said [Patacons] were laden for the accompt and adventure predeposed.

To the 16th hee saith hee is an Antwerper borne and inhabitant there and a
domestique servant to the producent, Otherwise negatively.

To the 17th hee referreth to his foregoing deposition, And otherwise cannot depose.

To the 18th hee saith there is no insurance made upon the said [?Patacons].

To the 19th & 20th hee referreth himselfe to his foregoing deposition.

To the 21th hee saith the bill fo lading by him predeposed was sent by the ordinary
packett boat or Poast to London to Mr. Rishoult as aforesaid. And otherwise
cannot depose.

To the 24 and 25th hee saith That it is commonly reported and knowne
amongst Merchants, That the transportation of sylver plate or peeces of
eight out of Spaine without permission is prohibited by the Lawes of that
land, but saith that notwithstanding the said prohibition it is usuall and ordinary
for Merchants to receive their returnes of silver from theure without any
Interruption Confiscation or losse of propriety in the same. And otherwise
cannot depose. And further hee cannot depose not haveing been in
Spaine nor knowing the lawes of that Nation.

expressely for the reclayming of the sylver and moneys predeposed. And

To the fourth hee saith the said Edward Peters is an Antwerper borne, and
hath lived there for all the time of this deponents knowledge of him, in the

as this deponent hath Credibly heard, and saith the said John Lamotte
is a Native of Brudges, and the said Elias Ertwegh of Duinquerke in

interrate, And otherwise saving his foregoing deposition hee saith hee cannot depose.

believe That the bills of lading annexed to the Allegation or the other bills
interrate were fictitious or Colourable, but made according to the trueth of
the matter therein contained.

for his use and accompt. Which this deponent well knoweth being Cashier and
Bookekeeper to Signore John Smeesters Merchant of Antwerp, who is an intimate
friend Correspondent and a Kinsman of the said producent, by meanes whereof
this deponent is familiarly versed in and [privie] to the negociation of the said
producent, and hath from time to tyme seene and perused his bookes of Accompts, and
letters of advise interchangeably sent betweene him and his said ffactors concerning
his silver trade in Spaine, and particularly shortly after the ladeing of the parcells of
silver and money predeposed, this deponent in the house of the said producent saw and
perused letters of advise sent over land by the Poast from Cadiz to the producent
at Antwerp by his said ffactors together Other two bills of lading concerning the
said silver and moneys, whereby the said ffactors intimated and expressed that
they had laden the severall parcells of silver and moneys above mentioned in
manner and forme and for the accompt as aforesaid, And this deponent then
also saw the booke of accompts of the said producent, wherein this deponent precontest
according to the Manner and Customs of Merchants had entred the said respective
parcells, whereby this deponent is fully assured of the trueth of the premisses,
and that no subject or subjects of the King of ffrance or States of the United

quantities of Ryssels stuffs and fflander lace and linnen to his said ffactors with order
to make him returnes thereof in silver plate and monies for his owne accompt, and
this deponent hath also seene and perused the said factors answers to the said producent
wherein they Certified him of the receipt thereof, and their intentions to doe
according to his order. And further cannot depose.

To the 15th hee saith the factors interrate did not at all acquainct this deponent for
whose accompt or adventure the said sylver was laden, otherwise then that this
deponent saw their letters wherein hee understood the same.

To the 16th hee saith hee is an Antwerper borne and dwelleth there. And otherwise negatively.

To the 17th hee cannot depose otherwise then hee hath predeposed.

To the 18th hee saith hee knoweth not of nor beleeveth any Insurance is made for the said sylver or any part thereof.

To the 21th hee saith, the bills of lading interrate were sent to Mr. Rishoult
a Merchant of London by the parket boate or ordinary passage from fflander. And
otherwise cannot depose.

To the 22. and 23th hee cannot depose.

To the 24. and 25th hee saith, It is commonly and generally spoken off amongst
Merchants, that the transportation of sylver out of Spaine without espetiall
permission is forbidden by his Catholique Majestie and the silver Confiscable to his
said Majestie if discovered by his Officers in Spaine, but saith That it is publique and notorious
that large returnes of silver notwithstanding the said prohibition are continually
made to Merchants in fflander without any losse of Propriety at all. And
otherwise cannot depose.

is perfectly well acquainted for which reasons hee is fully assured that the
said two bills of ladeing annexed were and are two of the originiall bills of lading
signed firmed and filled up at or neare Cadiz according to the absolute trueth of the
matter, observing them punctually to agree with the bills of lading so seene
and presentend by this deponent at Antwerp, before they were sent in a letter
(which this deponent also perused) to Mr. Rishoult a Merchant here in London
expressely for the reclayming of the sylver and moneys predeposed. And
further hee cannot depose.

To the last hee saith his foregoing deposition is true.

To the second hee saith hee hath knowne the interrate Edward Peters for
6 yeares last past or thereabouts, and the interrate John Lamotte for
about 4 yeares in person and Elias Ertwegh for about 4 yeares last past by Correspondency
And otherwise deposeth not, not being in the voyage in question.

To the third hee saith hee was not present at the ladeing of the peeces of
eight interrate.

To the fourth hee saith the said Edward Peters is an Antwerper borne, and
hath lived there for all the time of this deponents knowledge of him, in the
[?Kipdorp] streete with his family, and for severall yeares before had lived at Dover
as this deponent hath Credibly heard, and saith the said John Lamotte
is a Native of Brudges, and the said Elias Ertwegh of Duinquerke in
fflander and have lived in Cadiz ever since this deponent first knonwne
them by meanes of letters of Correspondency as aforesaid.

To the 5. and 6. hee saith hee did not see the signing of the bills of lading
interrate, And otherwise saving his foregoing deposition hee saith hee cannot depose.

To the 7th hee saith by vertue of his oath, That hee doeth not know nor
believe That the bills of lading annexed to the Allegation or the other bills
interrate were fictitious or Colourable, but made according to the trueth of
the matter therein contained.

producents affaires hee hath beene admitted to see and peruse severall letters

for his use and accompt. Which this deponent well knoweth being Cashier and
Bookekeeper to Signore John Smeesters Merchant of Antwerp, who is an intimate
friend Correspondent and a Kinsman of the said producent, by meanes whereof
this deponent is familiarly versed in and [privie] to the negociation of the said
producent, and hath from time to tyme seene and perused his bookes of Accompts, and
letters of advise interchangeably sent betweene him and his said ffactors concerning
his silver trade in Spaine, and particularly shortly after the ladeing of the parcells of
silver and money predeposed, this deponent in the house of the said producent saw and
perused letters of advise sent over land by the Poast from Cadiz to the producent

they had laden the severall parcells of silver and moneys above mentioned in
manner and forme and for the accompt as aforesaid, And this deponent then
also saw the booke of accompts of the said producent, wherein this deponent precontest
according to the Manner and Customs of Merchants had entred the said respective
parcells, whereby this deponent is fully assured of the trueth of the premisses,
and that no subject or subjects of the King of ffrance or States of the United

said shipps came to be seized and brought up into England, That then hee
should on his behalfe claime the said peeces of eight for his the said producent
use and accompt, which letter of advise the said Paul Marcier shortly after writt
unto the said producent that hee had received, and would doe according to his order.
The premisses this deponent knoweth, being in his said quality employed to transcribe
and Register the said letter of advise sent as aforesaid by the producent, and having

such accompted, and hath lived there for the time this deponent hath knowne him
living with his family in the Kipdorp streete in Antwerp, and the

second a Hamburgher borne are commonly accompted inhabitants of Cadiz
in Spaine. And further cannot depose.

To the 4th hee saith the [interrate] Edward Peters is an Antwerper borne and for
such accompted, and hath lived there for the time this deponent hath knowne him
living with his family in the Kipdorp streete in Antwerp, and the

second a Hamburgher borne are commonly accompted inhabitants of Cadiz
in Spaine. And further cannot depose.

To the 5. and 6th hee referreth himselfe to his foregoing deposition, And further

and subsequent assuredly believeth 9. of the originall bills of lading signed by
the respective Master and Otto George his Purser in his name at Cadiz upon the receipt.
of the said respective parcells of silver plate and moneys, videlicet: one bill of
lading for each parcell saving the two parcells of the marke '''P. F.''' laden
aboard the said shipp the Sampson, both which parcells were contayned in one
bill of lading. And saith this deponent: hath also seene in the Registry of this
Court nine other bills of lading of the same [tenure]: markes and numbers
filling up annd firmed with which the said bills annexed are marked numbered
filled up and firmed. And by the said facto [?]: letters of advise predeposed this
deponent. saith hee hath observed, That there were also duplicates of the said
bills left and remaining in their respective custodie at Cadiz. And saith that the bills annexed to the allegation and those remaineing in the registrey of
this Court were and are filled up and firmed by [aud ou/th] the severall
handwritings hereafter specified, videlicet those for the silver laden by William
Jansen are filled up with the handwriting of the said Jansens Scrivano or
Servant, and those for the silver laden by Peter Lois are filled up with his
owne handwriting, and those for the silver laden by John [Laurette] are
filled up with the handwriting of [Llerman] Laurette his brother, and of
himselfe, and the bills for the silver laden in the ''Sampson'' were and are firmed by the Purser of
Otto George, in his name, those in the ''Salvador'' by Christian Cloppenburgh,
and those in the ''Saint George'' by John Martins [?Dorp] with their owne
handwritings, which hee knoweth by the long experience and frequent obser-
-vation of the severall handwritings and firmes aforesaid, aswell as it is possible
for a man to know the handwriting of another wherein hee hath been long versed and
experienced. Hee further saith That the said bills of ladeing annexed to the
saith Allegation were sent unto and received by the said producent at
Antwerp in the moneths of August September October and Novelber 1652
, and saith the said producent hath [?snire] sent them
hither to one Master Rishoult and [?Coupaine] and his Correspondents purposely
to make use thereof in the reclayming of the said silver, All which said
bills of lading seene and presented by this deponent: hee for the reasons predeposed

To the 5th and 6th hee saith hee hath Credibly heard, and hath observed
by the said producents bookes of accompts, that hee the said producent
had formerly lived at Dover in England, and had from them for
severall yeares drive a trade to Spaine for silver and plate, and saith
the said producent is at present an inhabitant of Antwerp, and hath
lived there for about 6. yeares last past of this deponent knowledge, and is
a Subject of the King of Spaine, and for such was and is well knowne

the sayd woolls the foresayd shipp sett sayle [therewith] from Cadiz of this
deponents certaine knowledge, and saith It is notorious that the
sayd shipp was seized upon the Coast of England by some of the
shipps of this Commonwealth. and verily beleiveth that the sayd woolls
were aboard att the tyme of the seizure and that the sayd shipp and sayd
woolls were then bound to Ostend and to noe other Port. And further
that the sayd fferdinando Nunez was and is a merchant of Sevill
in Spaine and a Spaniard borne and a subiect of the King of Spaine
and an Inhabitant of Sevill with his family, and so hath bene for
ten yeares past and upward of this deponents knowledge being his
neighbour in Sevilia, to which sayd fferdinando Nunez the sayd woolls
[doe] solely [appartaine] and he alone [runns] the hazard and riske
thereof, which he knoweth for the reasons aforesayd. And further
saving his foregoeing depositions cannot depose.
