saw the said Sandiford, was on monday last near three weekes in that
Eaten Streete where the said Sandiford was on horseback come out of
the Maidenhead [?June] going for Manchester, [?whencer] hee said hee was to

hath received a [letter] from him dated at Liverpoole the twelveth instant
(which came to this deponents hands about three dayes after) and before

setting forth of the said shipp, and left instructions with this deponent in
writing about there setting out, and ordered this deponent to receive moneys
for her victualling and charges of Mr Wainewright and Mr John [?Tarleton]
and saith there are eight or nine [men] with this deponent were belonging
to and being the company of the said shipp, of which company her [saith]
there are [seaven] now aboard here, and further cannot answer saving
that this deponent now manageth and ordereth the busines of the said
shipps setting forth and proceeding on the voyage, according to the said
orders left him by Mr Sandiford.

To the 5th he saith hee cometh by the orders of Mr Cheeke his this
examinates [proctor] to be a witness in this busines, and saith that
when the said shipp was arrested, the said Mr Wainewright said hee
would baile her, and willed this deponent to looke after and follow the
business in this Court about getting her release from the arrest, and
to that purpose to goe to Mr Smith who hee said would direct him to a
proctor and a lawier, and this deponent comming accordingly thereabout
to Mr Smith, Mr Smith directed him to Mr Cheeke and this deponent
thereupon going to Mr Cheeke, acquainted him with Mr Sandifords
interest in the said shipp./

bills of lading for the arlate three baggs, and so much the sayd Christian
Cloppenbergh told this deponent att sea in their Course toward Oostend
before the seizure being a passenger aboard his shipp and did then
say and affirme that the sayd three baggs were the bags or money
of the sayd ffrancis de |Bois and that they should be as safely delivered
to him or his [?Assignies] att Ostend as if Bills of lading had bene signed by him the sayd
Cloppenbergh for the same. And further he cannot depose saving he
beleiveth that in case the sayd wind had not then happened and that the
sayd shipp had stayd so long as was first intended, Bills of lading would
have bene signed for the sayd three baggs arlate as well as there was for
the rest.

To the fourth he saith that the two bills of lading annexed to the allegation

Ottavo Jorge att the foot thereof which was written by Pedro purser of

the Originall Bills of Lading above by this deponent deposed of and were

To the fifth he saith that he hath noe personall knowledge of the arlate
Jacques Hoyes, but saith that he is commonly taken and reputed to be a
Merchant and ffactor at Ostend and to be a subiect of the King of
Spaine. and this deponent hath likewise credibly heard att Cadize
in Spaine before the sayd shipps departed from thence that the sayd Jacques
Hoyse had formerly done and dispatched busines for the sayd ffrancisco du

Examined upon the sayd Allegation

merchant aged three and thirty yeares or
thereabouts a witnes sworne and examined.

To the first and second Articles of the sayd Allegation, This deponent saith and
deposeth. That the arlate don Antonio da Ponte in the monthes of May June
July August September October and November 1652. was and att this
present is the true and lawfull Owner and Proprietor of the arlate six barrs
of sylver marked as in the margent that is to say two of the first
[FIRST MARKE, LHS]
and four of the second marke, and for lawfull Owner of the same
[SECOND MARKE, LHS]
was and is commonly accounted. And further saith that he this deponent
being att the West Indies in the sayd moneth of May 1652 there [?saw]
the arlate Don Antonio buy the same att the Havana, and afterwards
for his owne Accompt to embarque the same upon the ''Saint Juan Baptista''
Juan Sericho Master to be transported to Cadize arlate, whether the
sayd shipp the ''Saint John Baptista'' with the sayd sylver aboard safely
arrived, the producent being there in quiet possession thereof, towards
the latter end of July. And further saith that this deponent [?hath]
come from Havana aforsayd in another shipp of the Spanish plate [?ffleet]
saw the producent a few dayes after carry and take the [?arlate]
barrs of sylver marked as aforesayd from the ''Saint Juan Baptista''
aboard the shipp ''Sampson'' arlate this deponent being thne aboard
saw and tooke notice that the sayd producent laded the same for [?his]
owne Accompt to be transported to Oostend, and there to be deliverd [?to]
the sayd producent for his owne Accompt. And otherwise [?this]
deponent cannot depose, saving that the producent and this [?deponent]
came together with the sylver arlate from Cadize in this voyage
aboard the sayd shipp ''Sampson'' Otto George Master, and continued
constantly aboard from their first embarquing to the tyme of [?the] [?seizure]

To the third and fourth Articles this deponent saith that att the tyme [?of the]
lading of the sayd barrs of sylver, the arlate Pedro de Campo videlicet
was the Purser of the sayd shipp ''Sampson'', and the sayd Pedro aboard [?the]
sayd shipp in the precontest and sight of this deponent, (his this deponent
preconteste Lorenso de Veles and Pasquall Andrada being then likwewise []
signed three bills of ladeing all on one tenor, whereof the bill of []
to the sayd allegation annexed which he hath now seene and perused is a []
And the Contents thereof are true and were so had and [?doone] as [?in] [?]
is expressed. And saith that [?he] [?perfectly] reemembreth that the sayd [?bills]
all of them signed not long after the beginning of September []
on or about the very day in the bill annexed menioned as he [?beleiveth].
And further saith that afterwards the arlate shipp the ''Sampson''
the sayd six barrs of sylver being aboard, and this deponent a passenger
departed from the bay of Cadize towards Oostend, and [?in] her [?Ca]
thither after her arrivall in the Downes was taken and seized [?by]

|Transcription=To the third he saith and deposeth that three of the bills of Ladeing annexed to the
allegation and now showne to him this examinat, are three of those bills [?which]
this deponent saw signed and firmed as aforesayd. [?videlicet] that bill of Lading
with this name Ottavio Jorge att the foot thereof was and is one those [?bills]
signed by the Purser of the ''Sampson'' as aforesayd, and the two other bills [?h]
respectively att the foot of eyther of them this name Christian Cloppen[burgh]
the one for the sayd barr of sylver the other for the sayd two baggs [?of]
Mexico money were and are two of the aforesayd bills which this deponent
saw the sayd Christian Cloppenburgh signe as he hath predeposed;
and the other bill for the Chocolat now allso showne him he beleiveth was
signed by the sayd master. And further saith that the sayd [?Michael]
Perry came a Passenger in the ''Salvador'', and brought the aforesayd bill[s]
of lading with him to this Citty as this deponent beleiveth And further
referring himselfe to the [?Acts] of this [?Court] he cannot depose.

To the fourth he saith that of this deponents knowledge there was and is [?correspondence]
in the way of trade betweene the Producent and the sayd Nicolas [?Groote][?who]
is and hath for twelve years past lived att Antwerpe and is a subiect of the
King of Spaine. And this deponent knoweth that the sayd baggs of Peru
moneyes were laden aboard the ''Sampson'' two dayes before the Mexico
money and barr of sylver aforesayd were laden aboard the ''Salvador'', and [?the]
sayd Michael Perry being att the tyme of his lading the Peru money not
resolved to goe with the sayd shipps to fflanders caused the sayd baggs
of Peru money as he told this deponent, to be in the bills of lading [?for]
the same to be consigned to his sayd correspondent Nicholas Groote. And
further he cannot depose.

To the fifth he saith that for many years now past there hath bene and is
warr betweene the sayd King of Spaine and the King of ffrance, and their
Subiects, And peace and amity betweene the sayd King of ffrance and [?the]
State of Hamburgh of which State the arlate Arnout van [?Hasedonck]
of this deponents knowledge hath bene a Subiect for these twelve
years or thereabouts, and so is att this present. And he saith that the
arlate Michael Perry att his howse att St [Lucour] aforesayd, and likewise
att Cadize att the tyme of signing the sayd bills of lading did tell this
deponent, that he would, and did in the respective bills of lading
for the sayd Peru moneys aboard the ''Sampson'', and the sayd barr, and [?Mexico]
moneys laden aboard the ''Salvador'' make use of the name of the arlate
Arnout van [?Hasedonck]colourably onely for the better preserving
of the same from being made prize in case the shipps of the sayd
King of ffrance should happen to seize the saime, but sayd [?then][?and][?att]
other tymes likewise that in deed and truth the sayd plate and moneyes
were for his owne sole Accompt and adventure. and to the purpose
aforesayd he caused a letter to be sent from St Lucar aforesayd to his
Correspondent Nicholas Groot of Antwerpe, the effect whereof this
deponent hath sett forth in his deposition to the first article. And this
deponent moreover saith that the very day that the shipps ''Sampson''
and ''Salvador'' departed from Cadize the producent understanding that
this deponent was resolved within some small tyme after to goe for
Hamburgh in a shipp of Hamburgh then in the bay of Cadize, [?desired]
this deponent att his arrivall at Hampburgh aforesayd to acquaint the
sayd Arnout van Hasedonke that he the producent had made use of [?his]
name in the aforesayd bills of lading to the effect predeposed. which this
deponent did accordingly intimat to the sayd Hasedoncke soone after
his arrivall there as he had bene desired. And further he cannot depose.

To the sixth he saith that it is usually practised by some Spanish Merchants
to use the names of Hamburghers colourably to save their goods from
being made prize by the ffrench as is arlate. And otherwise he cannot
depose.
