To the 7th 8th and 9th arles- of the sayd allegation hee saith
that the sayd Keene hearing that this deponent and others who –
were the company of the Anne Pinck of Bristowe had had their seyd
vessell cast away neere Chippione not farr Off of St Lucar
did desyre this deponent and the rest of the sayd shipps company to –
goe with him his voyage to Palma but this deponent and all the sayd
shipps company told him they would not goe any voyage but for
England, for that the sayd Keene seeing hee could not get noe Mariners
to goe with him his voyage to Palma did at St Lucar take in a –
lading of goods for London, whereupon this deponent and the rest of the
sayd Pinke Anne of Bristowes company, did shipp them selves in the
sayd vessell the John and Elizabeth and did sayle her from St Lucar
to this Port of London And further he cannot depose
To the 10th hee saith hee well knoweth the arlates- Mr Peter Probee and
Mr Edward Watts and saith they are English men merchants of good –
repute and accompt in St Lucar and soe generally accompted And –
further to this arle- hee cannot depose /
To the Interries-
To the first he saith hee cometh to testifie the truth of his knowledge
In this cause at the request of Edward Keene the producent to whome
hee is noe way related saving hee served as a Mariner in his sayd
shipp John and Elizabeth in her voyage from St Lucar to London and was –
none of her company in her outward bound voyage from London /
To the second he saith the shipp Interr’ was fitted and repayred
at St Lucar for a voyage, and did there take a freight for –
London and saith hee well knoweth the sayd vessell could not soe well have gone to Palma
as for London for that noe Mariner would engage to goe in her upon
noe condition to Palma And further to this Interr’ he cannot depose
not being any of her company when shee came from London./

Dr. Smith 4 Richard Robinson of Wapping the the parish of
of [sic] Stepney Shipwright aged 28 yeares or there
abouts a witnes sworne and examined saith and
deposeth as followeth vizt./
To the 1:2:3: 4th and 5th articles of the sayd allegation hee saith that
hee this deponent is a shipp carpenter by profession and was Carpenter
of the shipp the Triall an English shipp lying in the harbour of St –
Lucar in Spaine and by that meanes did see the shipp the John and Elizabeth
[presently?]

cannot answere for that hee was none of the sayde shipps company in her
outwards bound voyage from London . saving hee saith that the Masters mate
who came in her to St Lucar and the boy then in her were both English /

Examined upon the sayd allegation
us
d : smith 3 William Compton of the parish of St Gyles
Cripplegate Mariner aged 35 yeares or
thereabouts a witnes sworne and examined saith and
deposeth as followeth vizt./

To the first article of the sayd allegation he saith that hee this deponent
was not one of the Company of the shipp John and Elizabeth at her first setting
out uppon the voyage in question but hee this deponent this deponent seeing her at
St Lucar after shee mett with the disaster in the subsequent arles- of this allegation
[mencioned?] and coming alsoe home to England from St Lucar in her as one of
her Company well knoweth and observed that shee was a new built
vessel and was very stronge light and staunch in her hull and every
way a strong vessell saving for the preiudice that happened to her by her
sayd disaster And further to this arle- he cannot dispose
To the 2 : 3 : 4th and 5th Articles of the sayd allegation her saith that
by Common reporte among Merchants and Sea men in St Lucar the
sayd shipp John and Elizabeth came into St Lucars harbour very sore -
battered and shattered having her midshipp broken down to the water
by a shipp in her company called the Supply her falling fowle on her in a storme
and her maine mast and bolspritt spent and lost and only a part of her mizen –
mast remayning which was used as a Jury mayne mast, for the better conducting –
her through the sea to harbour, after shee had as was reported beate
up and downe in that battered condition at Sea in a very violent storme
divers dayes togeather
utterly forsaken of all her Company save the Master and his Mate and a boy , all the rest having [upon?] the said Supplyes falling
[fowle?] of her as at [course and?] forsaken her and [gone away?] in the Supply and left her to the mercie of the Sea
And hee this deponent seeing her at St Lucar
after her coming in hither knoweth that when hee sawe her there shee was
not capable to proceede upon any voyage whatsoever and saith hee
for his part wondereth how shee got safe to harbour being soe battered
and bruised as shee was when hee sawe her and wanting her masts as aforesayd and almost
all thinges necessarie for her preservation And further to those articles –
hee cannot depose
To the 6th article he saith hee cannot depose anything thereto of his -
certaine knowledge but that hath heard that the artlate- Keene did hyre
two dutch men and a Scotch man to goe in his sayd shipp to –
Palma whether shee was (as it was sayd first bound) which men as was reported
Robbed his the sayd Keenes Cabbin of money therein and then came away
and left the shipps boate ashoare so that hee the sayd Keene could get noe company
of Mariners to goe to Palma And further to this arle- he cannot
depose /

dutch men and Scotch man (aftre they or some of them had broken open thee –
Masters Cabbin and robbed him of what moneys hee had there) ranne
away, and the sayd Keene not being able to get any mariners that
would proceede on the voyage to Palma
hyrede certaine mariners who belonged to a shipp called
the Anne Pinke of Bristoll and was cast away neere St Lucar, to serve
in her as mariners to the port of London, for that they refused to serve
in her for any other place, And further hee cannot depose saving
that the sayd vessell did accordingly come from St Lucars to London
this deponent served in her as Pylott and Masters Mate of her thither and
thereby he knoweth the premisses. . /
To the 9th saving his foregoing deposition he cannot depose./
To the 10th he saith hee knoweth the articulates Mr Probie and Mr Watts
and saith they are English merchants and of good Accompt and repute
in St Lucar articulate and farther saving his foregping deposition hee
cannot depose./

To the Crosse Interrogatories
To the first Interrogaory hee saith hee cometh to testifie and hath of his –
knowledge at the request of Mr Keene the [perducent?] and that hee was
only one of the Company of the Shipp John and Elizabeth in her voyage
hoewards from St Lucar to London and hath noe relation to the sayd
Keene save that hee [was?] his Mate and Pilott of the sayd Shipp in her
homewards voyage. And otherwise negatively. /
To the 2 hee saith he knoweth that the sayd vessell John and Elizabeth was
In some measure fitted and repayred at St Lucars and did take a –
freight for London for that none of her company there hyred would goe in her
to any other place, and saith in this deponents Judgment shee was not
soe fitt to have gone to Palma from as to London, for that
she wanted many things fitting –
to have gone to Palma, by reason the voyage is more dangerous
for fear of the turkey piratts and men of warr and other perils incident
thereto And further hee cannot answere not being of her company
in her voyage from London to St Lucar.

To the first Interrogatory he saith hee cometh to be a witness at the request of the ~
[producent?] Mr Keyne and saith hee is noe way related to him saving hee served
in the shipp Interrogate as a Common Mariner in her voyage home from St
Lucar to London, and was noe none of her company in her voyage from London to St Lucar
To the second Interrogatory hee saith the sayd vessell Interrogate was in some –
measure repaired at St Lucar and did there take in a freight for London
and saith hee beleaveth the sayd vessell was as able to have gone from
St Lucars to Palma with the goods Interrogate as to have come for London if –
Mariners could have bin procured at St Lucar to have gone thither but he saith
that all the mariners belonging to her [prefesed?] to goe in her to any place [but? gutter] to
London which was the reason as hee verily beleaveth the sayd Keyne could not
Proceede in his voyage to Palma. And further to this Interrogatorie hee
cannot

William Painter of debtford in the County of Kent
Mariner aged 30 yeares or thereabouts a witness sworne
And examined saith and deposeth as followeth vizt./

To the first second third 4th and 5th articles of the sayde allegacion hee saith that
hee this deponent was went from England to St Lucar in Spaine in a vessel
called the Triall belonging to the port of London and saith that after his ~
arrivall there the shipp John and Elizabeth was towed in by two -
ffrench boates into the harbour of St Lucar, and this deponent sawe that the sayd vessell –
the John and Elizabeth then had her midshipp broken downe and her
mayne mast broken downe and lost and her bolspritt broken downe and lost, and
her Mizzen Mast broken, a peece whereof was left and sett in plcae opf a mayne
maste to bring her the better through the sea into harbour, And saith that
at such her comming into harbour shee had only
her Master and one man more and a boy on board her, and saith shee was -
then in such a tattered condition that shee had much a doe to [live?] and –
get safe into harbour, and could not possibly in that condition have gone to –
the canaries, or any other place but what it should please God to drive her
unto, And saith that by Common reporte at St Lucar amongst merchants and
Seamean here. shee came to that disaster by reason of a great storme
which drave a certain shipp called the Supply (whereof as it was
sayd one fflute was Master) fowle of the sayd shipp the John and
Elizabeth and brake her midshipp and Mastes in manner as this deponent
hath expressed [hee?] sawe them at her comming to St Lucar, and [hee?] hath [also?] heard by the like common reporte that
all the Company of the sayd shipp John and Elizabeth upon such her disaster –
forsooke her (except the Master and one other man who was [mate?] and Pylott of her and a boy) and went with the Supplye aforesayde and this deponent –
well knoweth and sawe that at her comming to St Lucar there was noe more company on
board save the Master (who was sick) and the sayd Pylott and a boy, so that the sayd vessell
was in a very hazardous and dangerous condition, and by like publique report
the sayd vessell lay beating up and downe the sea in that broken and shattered condition
about sixteen dayes after shee was soe deserted of her company –
he saith the sayd shipp John and Elizabeth might [plainely?] be seen by [shee?] was a vere stronge ligh[t?] vessell and her –
belea[veth?] if shee had not [bin light shee must have foundered in the sea, having noe Crewe helpe on board her)
shattered as aforesayd. And further to these articles hee cannot exprese saving

To the 6th and 7th and 8th articles he saith that he this deponent did not see
the goods which came in the vessell the John and Elizabeth to St Lucar un laded
or delivered but hath heard they were delivered to the
arlates- Mr Watts and Mr Probie and saith that he knoweth that the articulate:
Kee[ne?] had hyred two dutch men & a Scotch man to serve
as Mariners in his sayd shipp (but whether to goe to Palma he knoweth
not) and saith that the English Consull at St Lucar did in the behalfe of
the sayd Keene speake to this deponent to serve as mate and Pylott in the sayd shipp
but
this deponent told him he would not serve in her to noe place
but for Englande where upon the said Consull willed this deponent
to goe on board her and told him shee should goe for England and this deponent
accordingly went aboard her and found the sayd two dutch men and a Scotch
man a board her and soon after this deponent comming aboard the sayd two
