were Owners and Proprieters of the sayd shipp the ''Agreement'' whereof the&lt;br /&gt;
sayd Giles Lawrence who was by the sayd owners appoynted to mann&lt;br /&gt;
and command her. the voyage in question was Master the premisses he &amp;amp;#91;knoweth&amp;amp;#93;&lt;br /&gt;
being himselfe a part owner of the tyme arlate and having within&lt;br /&gt;
that tyme or before her being left &amp;amp;#91;?stene&amp;amp;#93; the sayd Captain Lawrence in&lt;br /&gt;
possession of her in the name of the foresayd owners. And otherwise &lt;br /&gt;
cannot depose  &lt;br /&gt;

To the second third and fourth Articles of the sayd allegation This deponent saith&lt;br /&gt;
that in the moneths of may June July August September October and&lt;br /&gt;
November 1651 he this deponent was resideng att Naples and was the&lt;br /&gt;
factor Agent and Correspondent of the sayd Mr Hill Mr Hallet and Companie&lt;br /&gt;
and that within the sayd tyme the arlate George Farrington came to&lt;br /&gt;
naples and there before a notary there living did by contract &amp;amp;#91;?contract&amp;amp;#93;&lt;br /&gt;
and agree with this deponent that the sayd George Farrington&lt;br /&gt;
his Agents would deliver for the use of this deponent or his Assigne unto or upon such shipp or shipps as he this&lt;br /&gt;
deponent should send to receyve the same 1100 salmes of oyles of the &lt;br /&gt;
measure of Galipoly att a place called Petras, being in Morea, att&lt;br /&gt;
before or after the end of January 1652 stile of naples, and saith that&lt;br /&gt;
the sayd notary drew upp the forsaid Contract in writing in the presence of&lt;br /&gt;
him this deponent and the sayd George Farrington, and that a copye&lt;br /&gt;
thereof authentatied was delivered to this deponent by the notary which&lt;br /&gt;
drew the sayd Contract up, and detracted the sayd Copy out of his Protocoll&lt;br /&gt;
which authentick Copy this deponent sent from naples over to the Citty&lt;br /&gt;
to the forsayd Mr Hill Hallet and Company who have as he believeth exhibited&lt;br /&gt;
the same to this Court, to which copye in case it be so exhibited this&lt;br /&gt;
deponent for the certainty of the tyme, and other Circumstances&lt;br /&gt;

touch att Zant and there to stay 24 houres to receyve direction &amp;amp;#91;?of/from&amp;amp;#93;&lt;br /&gt;

As the waighte have lesse, soe the Books have continued&lt;br /&gt;
more waighte then they oughte, for there wee found a&lt;br /&gt;
cable of 16 fuche 4/4 &amp;amp;#91;?entered&amp;amp;#93; 2 hundreth waighte heavier then it&lt;br /&gt;
bare upon the scale, and when it was excused by two&lt;br /&gt;
yeares drying, wee compared for further triall 46 of &lt;br /&gt;
these with 46 of like length and size of the best Muscovia&lt;br /&gt;
provision as both waighed at their size takeing in, and&lt;br /&gt;
these waighed more by 7 tonne - 2 pounds - 2 hundreths - 26 which in money &lt;br /&gt;
riseth to 249 - 15 - 6; Againe comparinge a cable of 15&lt;br /&gt;
fuche of this more with an other from Muscovia of alated&lt;br /&gt;
making the English that was found heavier 4 1/2 and comparing&lt;br /&gt;
this making with itself a cable of VI suche .96 &amp;amp;#91;?fathom&amp;amp;#93;&lt;br /&gt;
weighed but 50 - 3 - 21. and another of VI suche, and  &lt;br /&gt;
but 93 &amp;amp;#91;?ffathom&amp;amp;#93; weighed 56 - 0 - 11 which is a difference &amp;amp;#91;?of&amp;amp;#93;&lt;br /&gt;

Steward of the said shipp the ''frederick'' aged&lt;br /&gt;
26 yeares or thereabouts a witnesse produced&lt;br /&gt;
sworne and examined upon the said interrogatories saieth and deposeth as followeth to witt&lt;br /&gt;

this deponent did not signe or see the said Originall Protest, nor&lt;br /&gt;

and having saluted the said Dutch fleet with the discharge&lt;br /&gt;
of the first peece of Ordnance without sharpe did sett sayle from amongst them &lt;br /&gt;
towards Bantam roade whereupon the said Dutch shipps &lt;br /&gt;
waighed their anchors also, and pursued him, and the said Admirall after some discourse had &lt;br /&gt;

To the second article of the sayd Allegation This deponent saith, that in the&lt;br /&gt;

Dominick Martin did by his facto Thomas Martin this deponents &amp;amp;#91;?personage&amp;amp;#93;&lt;br /&gt;
in this &amp;amp;#91;?imso&amp;amp;#93; drive a hade in the way of &amp;amp;#91;mXXshandifXm&amp;amp;#93; from Galloway&lt;br /&gt;
and also parts to Cadiz and &amp;amp;#91;&amp;amp;#93; in Spaine for for money plate and&lt;br /&gt;
sylver, the reason of this deponents knowledge in the &amp;amp;#91;p...XXXeX&amp;amp;#93; is that he&lt;br /&gt;
this deponent being att Amsterdam in the sayd yeare &amp;amp;#91;16X2&amp;amp;#93; and about&lt;br /&gt;
four or five monethes before the warr begann betwixt England and&lt;br /&gt;
Scotland did there see the sayd Dominick Martin and go &amp;amp;#91;XXnn&amp;amp;#93; this sayd Thoma&amp;amp;#91;s&amp;amp;#93;&lt;br /&gt;
Martin and the sayd dominick martin then &amp;amp;#91;XeX&amp;amp;#93; the sayd Thomas Martin from Amsterdam with a &lt;br /&gt;
Comission to be his facto in the sayd porte of Spain and sent along&lt;br /&gt;
with him a good quantity of Linnen Cloth and tanned hides of &amp;amp;#91;yXeal&amp;amp;#93;&lt;br /&gt;
value, and &amp;amp;#91;?allowed&amp;amp;#93; him to sell the same there and to make him returne&lt;br /&gt;
thereof as he should from tyme to tyme &amp;amp;#91;newiXX&amp;amp;#93; directions, and saith he&lt;br /&gt;
hath &amp;amp;#91;&amp;amp;#93; inedibly heard in Spaine and elsewhere that the sayd&lt;br /&gt;

To the third article of the sayd allegation This deponent saith that being about the&lt;br /&gt;
moneth of december last past att Bilboa in Spaine he this deponent&lt;br /&gt;
receyved a letter of &amp;amp;#91;?Advise&amp;amp;#93; from one Christopher Kirwan a &amp;amp;#91;mevihan&amp;amp;#93;&lt;br /&gt;
of Cadiz a Conesp anderl of this deponents in which letter it was&lt;br /&gt;
intimated to this deponent that sayd Thomas Martin in october&lt;br /&gt;
then &amp;amp;#91;neXX&amp;amp;#93; priding had for this sayd fathers Accompt laden severall&lt;br /&gt;
quantities of plate and moneyes att Cadiz &amp;amp;#91;Xonfiyned&amp;amp;#93; for ostend and&lt;br /&gt;
that the shipps whereon the same were laden in their Course for&lt;br /&gt;
ostend were seized by some of the shipps of this Comonwealth. And&lt;br /&gt;
saith that afterwards about the moneth of January &amp;amp;#91;16X2&amp;amp;#93; - this deponent&lt;br /&gt;
